55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the carrying, storage, or possession of a firearm or
88 firearm ammunition by certain persons on certain residential or
99 commercial property.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 30.05, Penal Code, is amended by adding
1212 Subsections (f-1) and (f-2) to read as follows:
1313 (f-1) It is an exception to the application of this section
1414 that:
1515 (1) the basis on which entry on the property was
1616 forbidden is that entry with a firearm or firearm ammunition was
1717 forbidden;
1818 (2) the actor is:
1919 (A) an owner of an apartment in a condominium
2020 regime governed by Chapter 81, Property Code;
2121 (B) an owner of a condominium unit governed by
2222 Chapter 82, Property Code;
2323 (C) a tenant or guest of an owner described by
2424 Paragraph (A) or (B); or
2525 (D) a guest of a tenant of an owner described by
2626 Paragraph (A) or (B);
2727 (3) the actor:
2828 (A) carries or stores a firearm or firearm
2929 ammunition in the condominium apartment or unit owner's apartment
3030 or unit;
3131 (B) carries a firearm or firearm ammunition
3232 directly en route to or from the condominium apartment or unit
3333 owner's apartment or unit;
3434 (C) carries a firearm or firearm ammunition
3535 directly en route to or from the actor's vehicle located in a
3636 parking area provided for residents or guests of the condominium
3737 property; or
3838 (D) carries or stores a firearm or firearm
3939 ammunition in the actor's vehicle located in a parking area
4040 provided for residents or guests of the condominium property; and
4141 (4) the actor is not otherwise prohibited by law from
4242 possessing a firearm or firearm ammunition.
4343 (f-2) It is an exception to the application of this section
4444 that:
4545 (1) the basis on which entry on a leased premises
4646 governed by Chapter 92 or 93, Property Code, was forbidden is that
4747 entry with a firearm or firearm ammunition was forbidden;
4848 (2) the actor is a tenant of the leased premises or the
4949 tenant's guest;
5050 (3) the actor:
5151 (A) carries or stores a firearm or firearm
5252 ammunition in the tenant's rental unit;
5353 (B) carries a firearm or firearm ammunition
5454 directly en route to or from the tenant's rental unit;
5555 (C) carries a firearm or firearm ammunition
5656 directly en route to or from the actor's vehicle located in a
5757 parking area provided for tenants or guests by the landlord of the
5858 leased premises; or
5959 (D) carries or stores a firearm or firearm
6060 ammunition in the actor's vehicle located in a parking area
6161 provided for tenants or guests by the landlord of the leased
6262 premises; and
6363 (4) the actor is not otherwise prohibited by law from
6464 possessing a firearm or firearm ammunition.
6565 SECTION 2. Section 30.06, Penal Code, is amended by adding
6666 Subsections (e-1) and (e-2) to read as follows:
6767 (e-1) It is an exception to the application of this section
6868 that:
6969 (1) the license holder is:
7070 (A) an owner of an apartment in a condominium
7171 regime governed by Chapter 81, Property Code;
7272 (B) an owner of a condominium unit governed by
7373 Chapter 82, Property Code;
7474 (C) a tenant or guest of an owner described by
7575 Paragraph (A) or (B); or
7676 (D) a guest of a tenant of an owner described by
7777 Paragraph (A) or (B); and
7878 (2) the license holder:
7979 (A) carries or stores a handgun in the
8080 condominium apartment or unit owner's apartment or unit;
8181 (B) carries a handgun directly en route to or
8282 from the condominium apartment or unit owner's apartment or unit;
8383 (C) carries a handgun directly en route to or
8484 from the license holder's vehicle located in a parking area
8585 provided for residents or guests of the condominium property; or
8686 (D) carries or stores a handgun in the license
8787 holder's vehicle located in a parking area provided for residents
8888 or guests of the condominium property.
8989 (e-2) It is an exception to the application of this section
9090 that:
9191 (1) the license holder is a tenant of a leased premises
9292 governed by Chapter 92 or 93, Property Code, or the tenant's guest;
9393 and
9494 (2) the license holder:
9595 (A) carries or stores a handgun in the tenant's
9696 rental unit;
9797 (B) carries a handgun directly en route to or
9898 from the tenant's rental unit;
9999 (C) carries a handgun directly en route to or
100100 from the license holder's vehicle located in a parking area
101101 provided for tenants or guests by the landlord of the leased
102102 premises; or
103103 (D) carries or stores a handgun in the license
104104 holder's vehicle located in a parking area provided for tenants or
105105 guests by the landlord of the leased premises.
106106 SECTION 3. Section 30.07, Penal Code, is amended by adding
107107 Subsections (e-1) and (e-2) to read as follows:
108108 (e-1) It is an exception to the application of this section
109109 that:
110110 (1) the license holder is:
111111 (A) an owner of an apartment in a condominium
112112 regime governed by Chapter 81, Property Code;
113113 (B) an owner of a condominium unit governed by
114114 Chapter 82, Property Code;
115115 (C) a tenant or guest of an owner described by
116116 Paragraph (A) or (B); or
117117 (D) a guest of a tenant of an owner described by
118118 Paragraph (A) or (B); and
119119 (2) the license holder:
120120 (A) carries or stores a handgun in the
121121 condominium apartment or unit owner's apartment or unit;
122122 (B) carries a handgun directly en route to or
123123 from the condominium apartment or unit owner's apartment or unit;
124124 (C) carries a handgun directly en route to or
125125 from the license holder's vehicle located in a parking area
126126 provided for residents or guests of the condominium property; or
127127 (D) carries or stores a handgun in the license
128128 holder's vehicle located in a parking area provided for residents
129129 or guests of the condominium property.
130130 (e-2) It is an exception to the application of this section
131131 that:
132132 (1) the license holder is a tenant of a leased premises
133133 governed by Chapter 92 or 93, Property Code, or the tenant's guest;
134134 and
135135 (2) the license holder:
136136 (A) carries or stores a handgun in the tenant's
137137 rental unit;
138138 (B) carries a handgun directly en route to or
139139 from the tenant's rental unit;
140140 (C) carries a handgun directly en route to or
141141 from the license holder's vehicle located in a parking area
142142 provided for tenants or guests by the landlord of the leased
143143 premises; or
144144 (D) carries or stores a handgun in the license
145145 holder's vehicle located in a parking area provided for tenants or
146146 guests by the landlord of the leased premises.
147147 SECTION 4. Section 82.002, Property Code, is amended by
148148 adding Subsection (c-1) to read as follows:
149149 (c-1) Section 82.121 applies to a condominium for which the
150150 declaration was recorded before January 1, 1994.
151151 SECTION 5. Subchapter C, Chapter 82, Property Code, is
152152 amended by adding Section 82.121 to read as follows:
153153 Sec. 82.121. POSSESSION OF FIREARM OR FIREARM AMMUNITION ON
154154 CONDOMINIUM PROPERTY. (a) Unless possession of a firearm or
155155 firearm ammunition on condominium property is prohibited by state
156156 or federal law, a condominium unit owner, or a tenant or guest of a
157157 condominium unit owner, or a guest of a tenant of a condominium unit
158158 owner may not be prohibited from lawfully possessing, carrying,
159159 transporting, or storing a firearm, any part of a firearm, or
160160 firearm ammunition:
161161 (1) in the condominium unit owner's unit;
162162 (2) in a vehicle located in a parking area provided for
163163 the residents or guests of the condominium property; or
164164 (3) in other common element locations as necessary to:
165165 (A) enter or exit the condominium property;
166166 (B) enter or exit the condominium unit owner's
167167 unit; or
168168 (C) enter or exit a vehicle on the condominium
169169 property or located in a parking area provided for residents or
170170 guests of the condominium property.
171171 (b) This section applies notwithstanding any provision of a
172172 dedicatory instrument to the contrary and regardless of the date of
173173 the provision's adoption.
174174 SECTION 6. Subchapter A, Chapter 92, Property Code, is
175175 amended by adding Section 92.026 to read as follows:
176176 Sec. 92.026. POSSESSION OF FIREARMS OR FIREARM AMMUNITION
177177 ON LEASED PREMISES. Unless possession of a firearm or firearm
178178 ammunition on a landlord's property is prohibited by state or
179179 federal law, a landlord may not prohibit a tenant or a tenant's
180180 guest from lawfully possessing, carrying, transporting, or storing
181181 a firearm, any part of a firearm, or firearm ammunition:
182182 (1) in the tenant's rental unit;
183183 (2) in a vehicle located in a parking area provided for
184184 tenants or guests by the landlord of the leased premises; or
185185 (3) in other locations controlled by the landlord as
186186 necessary to:
187187 (A) enter or exit the tenant's rental unit;
188188 (B) enter or exit the leased premises; or
189189 (C) enter or exit a vehicle on the leased
190190 premises or located in a parking area provided by the landlord for
191191 tenants or guests.
192192 SECTION 7. Chapter 93, Property Code, is amended by adding
193193 Section 93.014 to read as follows:
194194 Sec. 93.014. POSSESSION OF FIREARM OR FIREARM AMMUNITION ON
195195 LEASED PREMISES. Unless possession of a firearm or firearm
196196 ammunition on a landlord's property is prohibited by state or
197197 federal law, a landlord may not prohibit a tenant or a tenant's
198198 guest from lawfully possessing, carrying, transporting, or storing
199199 a firearm, any part of a firearm, or firearm ammunition:
200200 (1) on the tenant's leased premises;
201201 (2) in a vehicle located in a parking area provided for
202202 tenants or guests by the landlord of the leased premises; or
203203 (3) in other locations controlled by the landlord as
204204 necessary to:
205205 (A) enter or exit the tenant's leased premises;
206206 (B) enter or exit the leased premises; or
207207 (C) enter or exit a vehicle on the leased
208208 premises or located in a parking area provided by the landlord for
209209 tenants or guests.
210210 SECTION 8. Sections 30.05, 30.06, and 30.07, Penal Code, as
211211 amended by this Act, apply only to an offense committed on or after
212212 the effective date of this Act. An offense committed before the
213213 effective date of this Act is governed by the law in effect on the
214214 date the offense was committed, and the former law is continued in
215215 effect for that purpose. For purposes of this section, an offense
216216 was committed before the effective date of this Act if any element
217217 of the offense occurred before that date.
218218 SECTION 9. Sections 92.026 and 93.014, Property Code, as
219219 added by this Act, do not affect the enforceability of a provision
220220 in a lease agreement entered into or renewed before the effective
221221 date of this Act.
222222 SECTION 10. This Act takes effect September 1, 2019.
