| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter B, Chapter 112, Transportation Code, | |
| 11 | 11 | is amended by adding Section 112.0515 to read as follows: | |
| 12 | 12 | Sec. 112.0515. ENTRY ONTO PROPERTY: EXAMINATION OR SURVEY | |
| 13 | 13 | FOR HIGH-SPEED RAIL. (a) In this section, "high-speed rail" means | |
| 14 | 14 | intercity passenger service that is reasonably expected to reach | |
| 15 | 15 | speeds of at least 110 miles per hour. | |
| 16 | 16 | (b) A private entity may not enter on the lands or waters of | |
| 17 | 17 | any person or corporation under Section 112.051 to make an | |
| 18 | 18 | examination or survey, including a lineal survey, for a proposed | |
| 19 | 19 | high-speed rail facility unless the department has determined that | |
| 20 | 20 | the entity is a railroad company for the purposes of Section | |
| 21 | 21 | 112.002. | |
| 22 | 22 | (c) The department by rule shall adopt procedures to | |
| 23 | 23 | implement this section. | |
| 24 | 24 | SECTION 2. This Act takes effect September 1, 2019. |
