8 | 8 | | or youth, homeless children or youth, and unaccompanied youth. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 191, Health and Safety |
---|
11 | 11 | | Code, is amended by adding Section 191.0049 to read as follows: |
---|
12 | 12 | | Sec. 191.0049. BIRTH RECORD ISSUED TO FOSTER CHILD OR YOUTH |
---|
13 | 13 | | OR HOMELESS OR UNACCOMPANIED YOUTH. On request of a child or youth |
---|
14 | 14 | | described by this section, the state registrar, a local registrar, |
---|
15 | 15 | | or a county clerk shall issue, without fee or parental consent, a |
---|
16 | 16 | | certified copy of the child's or youth's birth record to: |
---|
17 | 17 | | (1) a homeless child or youth or an unaccompanied |
---|
18 | 18 | | youth as those terms are defined by 42 U.S.C. Section 11434a; |
---|
19 | 19 | | (2) a child in the managing conservatorship of the |
---|
20 | 20 | | Department of Family and Protective Services; and |
---|
21 | 21 | | (3) a young adult who: |
---|
22 | 22 | | (A) is at least 18 years of age, but younger than |
---|
23 | 23 | | 21 years of age; and |
---|
24 | 24 | | (B) resides in a foster care placement, the cost |
---|
25 | 25 | | of which is paid by the Department of Family and Protective |
---|
26 | 26 | | Services. |
---|
27 | 27 | | SECTION 2. Subchapter E, Chapter 521, Transportation Code, |
---|
28 | 28 | | is amended by adding Section 521.1015 to read as follows: |
---|
29 | 29 | | Sec. 521.1015. PERSONAL IDENTIFICATION CERTIFICATE ISSUED |
---|
30 | 30 | | TO FOSTER CHILD OR YOUTH, HOMELESS CHILD OR YOUTH, OR UNACCOMPANIED |
---|
31 | 31 | | YOUTH. (a) In this section: |
---|
32 | 32 | | (1) "Foster child or youth" means: |
---|
33 | 33 | | (A) a child in the managing conservatorship of |
---|
34 | 34 | | the Department of Family and Protective Services; or |
---|
35 | 35 | | (B) a young adult who: |
---|
36 | 36 | | (i) is at least 18 years of age, but younger |
---|
37 | 37 | | than 21 years of age; and |
---|
38 | 38 | | (ii) resides in a foster care placement, |
---|
39 | 39 | | the cost of which is paid by the Department of Family and Protective |
---|
40 | 40 | | Services. |
---|
41 | 41 | | (2) "Homeless child or youth" has the meaning assigned |
---|
42 | 42 | | by 42 U.S.C. Section 11434a. |
---|
43 | 43 | | (3) "Unaccompanied youth" has the meaning assigned by |
---|
44 | 44 | | 42 U.S.C. Section 11434a. |
---|
45 | 45 | | (b) This section applies to the application for a personal |
---|
46 | 46 | | identification certificate only for a foster child or youth, a |
---|
47 | 47 | | homeless child or youth, or an unaccompanied youth. |
---|
48 | 48 | | (c) Notwithstanding Section 521.101, Section 521.1426, or |
---|
49 | 49 | | any other provision of this chapter, a child or youth described by |
---|
50 | 50 | | Subsection (b) may, in applying for a personal identification |
---|
51 | 51 | | certificate: |
---|
52 | 52 | | (1) provide a copy of the child's or youth's birth |
---|
53 | 53 | | certificate as proof of the child's or youth's identity and United |
---|
54 | 54 | | States citizenship, as applicable; and |
---|
55 | 55 | | (2) if the child or youth does not have a residence or |
---|
56 | 56 | | domicile: |
---|
57 | 57 | | (A) provide a letter certifying the child or |
---|
58 | 58 | | youth is a homeless child or youth or an unaccompanied youth issued |
---|
59 | 59 | | by: |
---|
60 | 60 | | (i) the school district in which the child |
---|
61 | 61 | | or youth is enrolled; |
---|
62 | 62 | | (ii) the director of an emergency shelter |
---|
63 | 63 | | or transitional housing program funded by the United States |
---|
64 | 64 | | Department of Housing and Urban Development; or |
---|
65 | 65 | | (iii) the director of: |
---|
66 | 66 | | (a) a basic center for runaway and |
---|
67 | 67 | | homeless youth; or |
---|
68 | 68 | | (b) a transitional living program; or |
---|
69 | 69 | | (B) use the address of the regional office where |
---|
70 | 70 | | the Department of Family and Protective Services caseworker for the |
---|
71 | 71 | | child or youth is based. |
---|
72 | 72 | | (d) A child or youth described by Subsection (b) may apply |
---|
73 | 73 | | for and the department may issue a personal identification |
---|
74 | 74 | | certificate without the signature or presence of or permission from |
---|
75 | 75 | | a parent or guardian of the child or youth. |
---|
76 | 76 | | (e) A child or youth described by Subsection (b) is exempt |
---|
77 | 77 | | from the payment of any fee for the issuance of a personal |
---|
78 | 78 | | identification certificate under this chapter. |
---|
79 | 79 | | SECTION 3. Section 521.1811, Transportation Code, is |
---|
80 | 80 | | amended to read as follows: |
---|
81 | 81 | | Sec. 521.1811. WAIVER OF FEES FOR FOSTER CHILD OR YOUTH, |
---|
82 | 82 | | HOMELESS CHILD OR YOUTH, OR UNACCOMPANIED [CARE] YOUTH. A person is |
---|
83 | 83 | | exempt from the payment of any fee for the issuance of a driver's |
---|
84 | 84 | | license, as provided under this chapter, if that person is: |
---|
85 | 85 | | (1) younger than 18 years of age and in the managing |
---|
86 | 86 | | conservatorship of the Department of Family and Protective |
---|
87 | 87 | | Services; [or] |
---|
88 | 88 | | (2) at least 18 years of age, but younger than 21 years |
---|
89 | 89 | | of age, and resides in a foster care placement, the cost of which is |
---|
90 | 90 | | paid by the Department of Family and Protective Services; or |
---|
91 | 91 | | (3) a homeless child or youth or an unaccompanied |
---|
92 | 92 | | youth as those terms are defined by 42 U.S.C. Section 11434a. |
---|
93 | 93 | | SECTION 4. The changes in law made by this Act apply to an |
---|
94 | 94 | | application for a driver's license, personal identification |
---|
95 | 95 | | certificate, or birth record submitted on or after the effective |
---|
96 | 96 | | date of this Act. An application for a driver's license, personal |
---|
97 | 97 | | identification certificate, or birth record submitted before the |
---|
98 | 98 | | effective date of this Act is governed by the law in effect on the |
---|
99 | 99 | | date the application was submitted, and the former law is continued |
---|
100 | 100 | | in effect for that purpose. |
---|
101 | 101 | | SECTION 5. This Act takes effect September 1, 2019. |
