66 AN ACT
77 relating to personal identification documents for foster children
88 or youth, homeless children or youth, and unaccompanied youth.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 191, Health and Safety
1111 Code, is amended by adding Section 191.0049 to read as follows:
1212 Sec. 191.0049. BIRTH RECORD ISSUED TO FOSTER CHILD OR YOUTH
1313 OR HOMELESS OR UNACCOMPANIED YOUTH. On request of a child or youth
1414 described by this section, the state registrar, a local registrar,
1515 or a county clerk shall issue, without fee or parental consent, a
1616 certified copy of the child's or youth's birth record to:
1717 (1) a homeless child or youth or an unaccompanied
1818 youth as those terms are defined by 42 U.S.C. Section 11434a;
1919 (2) a child in the managing conservatorship of the
2020 Department of Family and Protective Services; and
2121 (3) a young adult who:
2222 (A) is at least 18 years of age, but younger than
2323 21 years of age; and
2424 (B) resides in a foster care placement, the cost
2525 of which is paid by the Department of Family and Protective
2626 Services.
2727 SECTION 2. Subchapter E, Chapter 521, Transportation Code,
2828 is amended by adding Section 521.1015 to read as follows:
2929 Sec. 521.1015. PERSONAL IDENTIFICATION CERTIFICATE ISSUED
3030 TO FOSTER CHILD OR YOUTH, HOMELESS CHILD OR YOUTH, OR UNACCOMPANIED
3131 YOUTH. (a) In this section:
3232 (1) "Foster child or youth" means:
3333 (A) a child in the managing conservatorship of
3434 the Department of Family and Protective Services; or
3535 (B) a young adult who:
3636 (i) is at least 18 years of age, but younger
3737 than 21 years of age; and
3838 (ii) resides in a foster care placement,
3939 the cost of which is paid by the Department of Family and Protective
4040 Services.
4141 (2) "Homeless child or youth" has the meaning assigned
4242 by 42 U.S.C. Section 11434a.
4343 (3) "Unaccompanied youth" has the meaning assigned by
4444 42 U.S.C. Section 11434a.
4545 (b) This section applies to the application for a personal
4646 identification certificate only for a foster child or youth, a
4747 homeless child or youth, or an unaccompanied youth.
4848 (c) Notwithstanding Section 521.101, Section 521.1426, or
4949 any other provision of this chapter, a child or youth described by
5050 Subsection (b) may, in applying for a personal identification
5151 certificate:
5252 (1) provide a copy of the child's or youth's birth
5353 certificate as proof of the child's or youth's identity and United
5454 States citizenship, as applicable; and
5555 (2) if the child or youth does not have a residence or
5656 domicile:
5757 (A) provide a letter certifying the child or
5858 youth is a homeless child or youth or an unaccompanied youth issued
5959 by:
6060 (i) the school district in which the child
6161 or youth is enrolled;
6262 (ii) the director of an emergency shelter
6363 or transitional housing program funded by the United States
6464 Department of Housing and Urban Development; or
6565 (iii) the director of:
6666 (a) a basic center for runaway and
6767 homeless youth; or
6868 (b) a transitional living program; or
6969 (B) use the address of the regional office where
7070 the Department of Family and Protective Services caseworker for the
7171 child or youth is based.
7272 (d) A child or youth described by Subsection (b) may apply
7373 for and the department may issue a personal identification
7474 certificate without the signature or presence of or permission from
7575 a parent or guardian of the child or youth.
7676 (e) A child or youth described by Subsection (b) is exempt
7777 from the payment of any fee for the issuance of a personal
7878 identification certificate under this chapter.
7979 SECTION 3. Section 521.1811, Transportation Code, is
8080 amended to read as follows:
8181 Sec. 521.1811. WAIVER OF FEES FOR FOSTER CHILD OR YOUTH,
8282 HOMELESS CHILD OR YOUTH, OR UNACCOMPANIED [CARE] YOUTH. A person is
8383 exempt from the payment of any fee for the issuance of a driver's
8484 license, as provided under this chapter, if that person is:
8585 (1) younger than 18 years of age and in the managing
8686 conservatorship of the Department of Family and Protective
8787 Services; [or]
8888 (2) at least 18 years of age, but younger than 21 years
8989 of age, and resides in a foster care placement, the cost of which is
9090 paid by the Department of Family and Protective Services; or
9191 (3) a homeless child or youth or an unaccompanied
9292 youth as those terms are defined by 42 U.S.C. Section 11434a.
9393 SECTION 4. The changes in law made by this Act apply to an
9494 application for a driver's license, personal identification
9595 certificate, or birth record submitted on or after the effective
9696 date of this Act. An application for a driver's license, personal
9797 identification certificate, or birth record submitted before the
9898 effective date of this Act is governed by the law in effect on the
9999 date the application was submitted, and the former law is continued
100100 in effect for that purpose.
101101 SECTION 5. This Act takes effect September 1, 2019.
