| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 386.154(d), Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (d) A new light-duty motor vehicle powered by an electric |
|---|
| 13 | 13 | | drive is eligible for a $2,500 incentive if the vehicle: |
|---|
| 14 | 14 | | (1) has four wheels or is a motorcycle as defined by |
|---|
| 15 | 15 | | 541.201, Transportation Code; |
|---|
| 16 | 16 | | (2) was manufactured for use primarily on public |
|---|
| 17 | 17 | | streets, roads, and highways; |
|---|
| 18 | 18 | | (3) has not been modified from the original |
|---|
| 19 | 19 | | manufacturer's specifications; |
|---|
| 20 | 20 | | (4) has a maximum speed capability of at least 55 miles |
|---|
| 21 | 21 | | per hour; |
|---|
| 22 | 22 | | (5) is propelled to a significant extent by an |
|---|
| 23 | 23 | | electric motor that draws electricity from a hydrogen fuel cell or |
|---|
| 24 | 24 | | from a battery that: |
|---|
| 25 | 25 | | (A) has a capacity of not less than four kilowatt |
|---|
| 26 | 26 | | hours; and |
|---|
| 27 | 27 | | (B) is capable of being recharged from an |
|---|
| 28 | 28 | | external source of electricity; and |
|---|
| 29 | 29 | | (6) was acquired on or after September 1, 2013, or a |
|---|
| 30 | 30 | | later date as established by the commission, by the person applying |
|---|
| 31 | 31 | | for the incentive under this subsection and for use or lease by that |
|---|
| 32 | 32 | | person and not for resale. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2019. |
