66 AN ACT
77 relating to the office of minority statistics and engagement in the
88 Department of Family and Protective Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 40, Human Resources Code,
1111 is amended by adding Section 40.043 to read as follows:
1212 Sec. 40.043. OFFICE OF MINORITY STATISTICS AND ENGAGEMENT.
1313 (a) In this section:
1414 (1) "Institution of higher education" has the meaning
1515 assigned by Section 61.003, Education Code.
1616 (2) "Office" means the office of minority statistics
1717 and engagement established under this section.
1818 (b) Using existing resources, the department, in
1919 consultation with an institution of higher education and the child
2020 welfare community, shall establish an office of minority statistics
2121 and engagement within the department to address the
2222 disproportionality in the rate of use of child protective and
2323 welfare services by and the provision of those services to children
2424 who are members of a racial or ethnic minority group and are in the
2525 child welfare system.
2626 (c) In collaboration with an institution of higher
2727 education and appropriate persons in the child welfare community,
2828 the office shall identify the causes of the disproportionality
2929 described by Subsection (b) and develop recommendations for
3030 addressing those causes and for improving the rate of use of child
3131 protective and welfare services by and the provision of those
3232 services to children and their families. In identifying the causes
3333 and developing recommendations, the office shall:
3434 (1) share with the institution any information
3535 necessary for the institution to assist in identifying the causes
3636 and developing recommendations;
3737 (2) consider the unique needs and resources of this
3838 state; and
3939 (3) consider the outcomes for children in the child
4040 welfare system and the services necessary to improve the outcomes.
4141 (d) The office shall annually submit a written report to the
4242 governor, lieutenant governor, speaker of the house of
4343 representatives, and chair of each standing legislative committee
4444 with primary jurisdiction over the department that includes:
4545 (1) the recommendations developed under Subsection
4646 (c);
4747 (2) methods to address disproportionality across the
4848 child welfare system; and
4949 (3) a summary of the initiatives developed by the
5050 department during the preceding year to address the causes of
5151 disproportionality identified in Subsection (c).
5252 SECTION 2. This Act takes effect September 1, 2019.
