66 AN ACT
77 relating to the deployment of advanced metering and meter
88 information networks in certain areas outside of ERCOT.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter L, Chapter 39, Utilities Code, is
1111 amended by adding Section 39.5521 to read as follows:
1212 Sec. 39.5521. METERING. (a) Notwithstanding Section
1313 39.552, an electric utility subject to this subchapter that elects
1414 to deploy advanced metering and meter information networks may
1515 recover reasonable and necessary costs incurred in deploying
1616 advanced metering and meter information networks. An electric
1717 utility that elects to deploy advanced metering or meter
1818 information networks is subject to commission rules adopted under
1919 Sections 39.107(h) and (k). The commission shall ensure that any
2020 deployment plan approved under this section and any related
2121 customer surcharge:
2222 (1) are not applicable to customer accounts that
2323 receive service at transmission voltage; and
2424 (2) are consistent with commission rules related to
2525 advanced metering systems regarding:
2626 (A) customer protections;
2727 (B) data security, privacy, and ownership; and
2828 (C) options given consumers to continue to
2929 receive service through a non-advanced meter.
3030 (b) An electric utility subject to this subchapter that
3131 elects to deploy an advanced meter information network shall deploy
3232 the network as rapidly as practicable to allow customers to better
3333 manage energy use and control costs.
3434 SECTION 2. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2019.
