| 7 | 7 | | relating to registration as an organ donor and a voluntary |

| 8 | 8 | | contribution to the organ donor registry when applying for a |
|---|
| 9 | 9 | | hunting or fishing license. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 12, Parks and Wildlife |
|---|
| 12 | 12 | | Code, is amended by adding Sections 12.0075 and 12.0076 to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | Sec. 12.0075. ORGAN DONOR REGISTRATION. A person who is |
|---|
| 15 | 15 | | authorized under this code to issue a hunting or fishing license of |
|---|
| 16 | 16 | | any type, including a combination hunting and fishing license, |
|---|
| 17 | 17 | | shall, at the time an applicant applies for a hunting or fishing |
|---|
| 18 | 18 | | license: |
|---|
| 19 | 19 | | (1) specifically ask the applicant only the question, |
|---|
| 20 | 20 | | "Would you like to register as an organ donor?"; and |
|---|
| 21 | 21 | | (2) if the applicant responds affirmatively to the |
|---|
| 22 | 22 | | question asked under Subdivision (1), provide the applicant's name, |
|---|
| 23 | 23 | | date of birth, driver's license number, most recent address, and |
|---|
| 24 | 24 | | other information needed for identification purposes at the time of |
|---|
| 25 | 25 | | donation to the nonprofit organization designated to maintain and |
|---|
| 26 | 26 | | administer the statewide donor registry under Section 692A.020, |
|---|
| 27 | 27 | | Health and Safety Code, for inclusion in the registry. |
|---|
| 28 | 28 | | Sec. 12.0076. VOLUNTARY CONTRIBUTION TO ORGAN DONOR |
|---|
| 29 | 29 | | REGISTRY. (a) When a person applies for a hunting or fishing |
|---|
| 30 | 30 | | license of any type, including a combination hunting and fishing |
|---|
| 31 | 31 | | license, under this code, the person may make a voluntary |
|---|
| 32 | 32 | | contribution to the nonprofit organization designated to maintain |
|---|
| 33 | 33 | | and administer the statewide donor registry under Section 692A.020, |
|---|
| 34 | 34 | | Health and Safety Code. |
|---|
| 35 | 35 | | (b) The department shall: |
|---|
| 36 | 36 | | (1) include space on the first page of each |
|---|
| 37 | 37 | | application for a hunting or fishing license that allows a person |
|---|
| 38 | 38 | | applying for the license to indicate the amount that the person is |
|---|
| 39 | 39 | | voluntarily contributing to the organization; and |
|---|
| 40 | 40 | | (2) provide an opportunity for the person to |
|---|
| 41 | 41 | | contribute to the organization during the application process for a |
|---|
| 42 | 42 | | hunting or fishing license on the department's Internet website. |
|---|
| 43 | 43 | | (c) The department shall send any contribution made under |
|---|
| 44 | 44 | | this section to the comptroller for deposit to the credit of the |
|---|
| 45 | 45 | | Glenda Dawson Donate Life-Texas Registry fund created under Section |
|---|
| 46 | 46 | | 692A.020, Health and Safety Code, not later than the 14th day of |
|---|
| 47 | 47 | | each month. Before sending the money to the comptroller, the |
|---|
| 48 | 48 | | department may deduct money equal to the amount of reasonable |
|---|
| 49 | 49 | | expenses for developing and administering this section, not to |
|---|
| 50 | 50 | | exceed two percent of the money collected under this section. |
|---|
| 51 | 51 | | SECTION 2. To implement Sections 12.0075 and 12.0076, Parks |
|---|
| 52 | 52 | | and Wildlife Code, as added by this Act, the Parks and Wildlife |
|---|
| 53 | 53 | | Commission shall adopt rules as needed and the Parks and Wildlife |
|---|
| 54 | 54 | | Department shall develop procedures to implement those sections. |
|---|
| 55 | 55 | | SECTION 3. This Act takes effect September 1, 2019. |
