66 AN ACT
77 relating to registration as an organ donor and a voluntary
88 contribution to the organ donor registry when applying for a
99 hunting or fishing license.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 12, Parks and Wildlife
1212 Code, is amended by adding Sections 12.0075 and 12.0076 to read as
1313 follows:
1414 Sec. 12.0075. ORGAN DONOR REGISTRATION. A person who is
1515 authorized under this code to issue a hunting or fishing license of
1616 any type, including a combination hunting and fishing license,
1717 shall, at the time an applicant applies for a hunting or fishing
1818 license:
1919 (1) specifically ask the applicant only the question,
2020 "Would you like to register as an organ donor?"; and
2121 (2) if the applicant responds affirmatively to the
2222 question asked under Subdivision (1), provide the applicant's name,
2323 date of birth, driver's license number, most recent address, and
2424 other information needed for identification purposes at the time of
2525 donation to the nonprofit organization designated to maintain and
2626 administer the statewide donor registry under Section 692A.020,
2727 Health and Safety Code, for inclusion in the registry.
2828 Sec. 12.0076. VOLUNTARY CONTRIBUTION TO ORGAN DONOR
2929 REGISTRY. (a) When a person applies for a hunting or fishing
3030 license of any type, including a combination hunting and fishing
3131 license, under this code, the person may make a voluntary
3232 contribution to the nonprofit organization designated to maintain
3333 and administer the statewide donor registry under Section 692A.020,
3434 Health and Safety Code.
3535 (b) The department shall:
3636 (1) include space on the first page of each
3737 application for a hunting or fishing license that allows a person
3838 applying for the license to indicate the amount that the person is
3939 voluntarily contributing to the organization; and
4040 (2) provide an opportunity for the person to
4141 contribute to the organization during the application process for a
4242 hunting or fishing license on the department's Internet website.
4343 (c) The department shall send any contribution made under
4444 this section to the comptroller for deposit to the credit of the
4545 Glenda Dawson Donate Life-Texas Registry fund created under Section
4646 692A.020, Health and Safety Code, not later than the 14th day of
4747 each month. Before sending the money to the comptroller, the
4848 department may deduct money equal to the amount of reasonable
4949 expenses for developing and administering this section, not to
5050 exceed two percent of the money collected under this section.
5151 SECTION 2. To implement Sections 12.0075 and 12.0076, Parks
5252 and Wildlife Code, as added by this Act, the Parks and Wildlife
5353 Commission shall adopt rules as needed and the Parks and Wildlife
5454 Department shall develop procedures to implement those sections.
5555 SECTION 3. This Act takes effect September 1, 2019.
