57 relating to the development of an individualized education program
68 for a public school student with a visual impairment.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 30.002, Education Code, is amended by
911 amending Subsection (f) and adding Subsection (f-1) to read as
1012 follows:
1113 (f) In the development of the individualized education
1214 program for a [functionally blind] student with a visual
1315 impairment, proficiency in [braille] reading and writing is a
1416 significant indicator of [presumed to be essential for] the
1517 student's satisfactory educational progress. The individualized
1618 education program for a student with a visual impairment must
1719 include instruction in [Each functionally blind student is entitled
1820 to] braille and the use of braille unless the student's admission,
1921 review, and dismissal committee determines and documents that
2022 braille is not an appropriate literacy medium for the student. The
2123 committee's determination must be based on an evaluation of the
2224 student's appropriate literacy media and literacy skills and the
2325 student's current and future instructional needs [reading and
2426 writing instruction that is sufficient to enable the student to
2527 communicate with the same level of proficiency as other students of
2628 comparable ability who are at the same grade level]. Braille
2729 instruction:
2830 (1) may be used in combination with other special
2931 education services appropriate to the student's educational needs;
3032 and
3133 (2) shall be provided by a teacher certified to teach
3234 students with visual impairments[. The assessment of each
3335 functionally blind student for the purpose of developing the
3436 student's individualized education program must include
3537 documentation of the student's strengths and weaknesses in braille
3638 skills].
3739 (f-1) Each person assisting in the development of the [a
3840 functionally blind student's] individualized education program for
3941 a student with a visual impairment shall receive information
4042 describing the benefits of braille instruction. [Each functionally
4143 blind student's individualized education program must specify the
4244 appropriate learning medium based on the assessment report and
4345 ensure that instruction in braille will be provided by a teacher
4446 certified to teach students with visual impairments. For purposes
4547 of this subsection, the agency shall determine the criteria for a
4648 student to be classified as functionally blind.]
4749 SECTION 2. This Act applies beginning with the 2019-2020
4850 school year.
4951 SECTION 3. This Act takes effect immediately if it receives
5052 a vote of two-thirds of all the members elected to each house, as
5153 provided by Section 39, Article III, Texas Constitution. If this
5254 Act does not receive the vote necessary for immediate effect, this
5355 Act takes effect September 1, 2019.
