66 AN ACT
77 relating to a study on the state certification of music therapists.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. DEFINITIONS. In this Act:
1010 (1) "Advisory council" means the Advisory Council on
1111 Music Therapy.
1212 (2) "Commission" means the Health and Human Services
1313 Commission.
1414 (3) "Music therapist" means a person who has completed
1515 an approved music therapy program and holds a certification by the
1616 Certification Board for Music Therapists to practice music therapy
1717 or provide music therapy services to a client for compensation.
1818 (4) "Music therapy" means the clinical and
1919 evidence-based use of music interventions by a music therapist to
2020 accomplish individualized goals for persons who are in a
2121 therapeutic relationship with the music therapist. The use of
2222 music interventions may include music improvisation, receptive
2323 music listening, songwriting, lyric discussion, music and imagery,
2424 singing, music performance, learning through music, music combined
2525 with other arts, music-assisted relaxation, music-based patient
2626 education, electronic music technology, adapted music
2727 intervention, and movement to music. The practice of music therapy
2828 does not include the diagnosis or assessment of any physical,
2929 mental, or communication disorder.
3030 SECTION 2. ADVISORY COUNCIL ON MUSIC THERAPY. (a) The
3131 Advisory Council on Music Therapy is created to conduct a study on
3232 the need for state recognition of music therapists.
3333 (b) Subject to Subsections (c) and (d) of this section, the
3434 advisory council consists of nine members appointed by the governor
3535 as follows:
3636 (1) two members who are music therapists in this
3737 state;
3838 (2) one member who is a music therapist in this state
3939 and represents an institution of higher education, as defined by
4040 Section 61.003, Education Code, that has a music therapy program;
4141 (3) one member who is a physician licensed in this
4242 state who specializes in critical care;
4343 (4) one member who is a social worker or professional
4444 counselor licensed in this state;
4545 (5) one member who is a special education
4646 administrator for a school district;
4747 (6) one member who employs one or more music
4848 therapists;
4949 (7) one member who is a client, or a representative of
5050 a client, of a music therapist and has received music therapy
5151 services; and
5252 (8) one member who is:
5353 (A) a speech-language pathologist licensed in
5454 this state;
5555 (B) a physical therapist licensed in this state;
5656 or
5757 (C) an occupational therapist licensed in this
5858 state.
5959 (c) The lieutenant governor and the speaker of the house of
6060 representatives shall each submit to the governor a list of
6161 candidates who meet the qualifications for appointment under
6262 Subsection (b) of this section. The candidates must represent
6363 different racial, ethnic, and linguistic backgrounds.
6464 (d) Not later than the 90th day after the effective date of
6565 this Act, the governor shall appoint the nine members to the
6666 advisory council from the list of candidates submitted under
6767 Subsection (c) of this section.
6868 (e) The members of the advisory council shall designate a
6969 member of the advisory council to serve as presiding officer.
7070 (f) A member of the advisory council may not receive
7171 compensation for service on the advisory council.
7272 (g) The commission shall provide administrative and staff
7373 support for the advisory council.
7474 (h) The advisory council shall study the core competencies
7575 of a music therapist, including the skills and areas of knowledge
7676 that are essential to bringing about expanded health and wellness
7777 in diverse communities and reducing health disparities. The core
7878 competencies of a music therapist may also include basic knowledge
7979 of:
8080 (1) materials used to educate the public regarding
8181 music therapist certification;
8282 (2) the benefits of music therapy;
8383 (3) the use of music therapy by individuals and in
8484 facilities or institutional settings;
8585 (4) culturally competent communication and care;
8686 (5) the use of music therapy for behavior change;
8787 (6) the resources and support available from the
8888 American Music Therapy Association or its successor organization
8989 and the Certification Board for Music Therapists or its successor
9090 organization;
9191 (7) the educational and clinical training
9292 requirements for a music therapist; and
9393 (8) any continuing education requirements for a music
9494 therapist.
9595 (i) In conducting the study under Subsection (h) of this
9696 section, the advisory council shall consult with the American Music
9797 Therapy Association, the Certification Board for Music Therapists,
9898 and other experts as needed.
9999 SECTION 3. REPORT. (a) Not later than the second
100100 anniversary of the date of the advisory council's first meeting,
101101 the advisory council shall submit a report to the governor, the
102102 lieutenant governor, the speaker of the house of representatives,
103103 the Senate Health and Human Services Committee, the House Public
104104 Health Committee, and the House Human Services Committee, or the
105105 successor to those committees, and the commission.
106106 (b) The report must include:
107107 (1) a summary of research regarding the best
108108 practices, curriculum, and training programs for music therapists
109109 and the need for quality and accredited training in providing music
110110 interventions related to health, recovery, and wellness;
111111 (2) recommendations regarding the need and
112112 feasibility of state certification of music therapists, including
113113 the impact of state certification on consumer access to music
114114 therapy services through state agencies, including the Texas
115115 Education Agency and the commission;
116116 (3) recommendations regarding procedures for the
117117 state certification of music therapists, including a system for the
118118 renewal of certifications and for the approval and accreditation of
119119 curriculum and training programs for music therapists; and
120120 (4) recommendations for best practices for
121121 third-party reimbursement options and other methods through which
122122 secure funding for music therapists may be obtained.
123123 (c) The commission shall publish the report on the
124124 commission's Internet website.
125125 SECTION 4. EXPIRATION DATE. The advisory council is
126126 abolished and this Act expires September 1, 2022.
127127 SECTION 5. EFFECTIVE DATE. This Act takes effect September
128128 1, 2019.
