55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a municipality to lower speed limits on
88 certain highways.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 545.356(b-1), (c), and (d),
1111 Transportation Code, are amended to read as follows:
1212 (b-1) Except as provided by Subsection (b-3), the governing
1313 body of a municipality, for a highway or a part of a highway in the
1414 municipality that is not an officially designated or marked highway
1515 or road of the state highway system, may declare a lower speed limit
1616 of not less than 20 [25] miles per hour, if the governing body
1717 determines that the prima facie speed limit on the highway is
1818 unreasonable or unsafe.
1919 (c) A prima facie speed limit that is altered by the
2020 governing body of a municipality under Subsection (b)[, (b-1),] or
2121 (b-3) is effective when the governing body erects signs giving
2222 notice of the new limit [and at all times or at other times as
2323 determined]. A prima facie speed limit that is altered by the
2424 governing body of a municipality under Subsection (b-1) is
2525 effective when the governing body erects signs or has completed a
2626 public education campaign giving notice of the new limit that
2727 includes notification of the effective date of the change.
2828 (d) The governing body of a municipality that declares a
2929 lower speed limit on a highway or part of a highway under Subsection
3030 (b-1) or (b-3), not later than February 1 of each year, shall
3131 publish on its Internet website and submit to the department a
3232 report that compares for each of the two previous calendar years:
3333 (1) the number of traffic citations issued by peace
3434 officers of the municipality and the alleged speed of the vehicles,
3535 for speed limit violations on the highway or part of the highway;
3636 [(2) the number of warning citations issued by peace
3737 officers of the municipality on the highway or part of the highway;]
3838 and
3939 (2) [(3)] the number of vehicular accidents that
4040 resulted in injury or death and were attributable to speed limit
4141 violations on the highway or part of the highway.
4242 SECTION 2. This Act takes effect September 1, 2019.
