9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 13.1002, Agriculture Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | Sec. 13.1002. EXEMPTION OF CERTAIN WEIGHING OR MEASURING | |
13 | 13 | DEVICES. Notwithstanding any other law, a commercial weighing or | |
14 | 14 | measuring device [that is exclusively used to weigh food sold for | |
15 | 15 | immediate consumption] is exempt from this subchapter, including | |
16 | 16 | the inspection requirements under Section 13.101 and the | |
17 | 17 | registration requirements under Section 13.1011, if the device is | |
18 | 18 | exclusively used to weigh food: | |
19 | 19 | (1) sold ready for immediate consumption, regardless | |
20 | 20 | of whether the food is consumed on the premises where the food is | |
21 | 21 | weighed and sold; and | |
22 | 22 | (2) not exempted from sales and use taxes under | |
23 | 23 | Section 151.314, Tax Code. | |
24 | 24 | SECTION 2. This Act takes effect immediately if it receives | |
25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
28 | 28 | Act takes effect September 1, 2019. |
