66 AN ACT
77 relating to the creation of a business advisory council on disaster
88 recovery and mitigation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 31, Natural Resources
1111 Code, is amended by adding Section 31.069 to read as follows:
1212 Sec. 31.069. BUSINESS ADVISORY COUNCIL ON DISASTER RECOVERY
1313 AND MITIGATION. (a) In this section:
1414 (1) "Advisory council" means the business advisory
1515 council on disaster recovery and mitigation established under this
1616 section.
1717 (2) "Disaster" has the meaning assigned by Section
1818 418.004, Government Code.
1919 (b) The business advisory council on disaster recovery and
2020 mitigation is established to provide to the commissioner advice and
2121 expertise on disaster recovery and mitigation as described by
2222 Subsection (g).
2323 (c) The advisory council is composed of six representatives
2424 appointed by the commissioner as follows:
2525 (1) one member representing banking and insurance
2626 entities in this state that provide mortgage lending and insurance
2727 for homeowners and businesses;
2828 (2) one member representing construction entities in
2929 this state engaged in the construction of commercial, industrial,
3030 and residential buildings;
3131 (3) one member representing the manufacturers in this
3232 state that produce construction materials;
3333 (4) one member representing the oil and gas refiners
3434 and processing industries having major industrial infrastructure
3535 in areas of this state adjacent to the Gulf of Mexico that are most
3636 vulnerable to damage from hurricanes and flooding;
3737 (5) one member representing the tourist and
3838 hospitality industry in areas of this state adjacent to the Gulf of
3939 Mexico that are most vulnerable to damage from hurricanes and
4040 flooding; and
4141 (6) one member representing small businesses in this
4242 state that would be affected following a disaster by loss of
4343 customers, lost employees, and limited insurance.
4444 (d) Members of the advisory council serve staggered
4545 four-year terms.
4646 (e) An advisory council member is not entitled to
4747 compensation but is entitled to reimbursement for travel expenses
4848 incurred by the member while conducting the business of the
4949 advisory council.
5050 (f) The advisory council members shall elect a presiding
5151 officer from among the members.
5252 (g) The advisory council shall:
5353 (1) provide advice on disaster recovery mitigation and
5454 resilience, specifically related to housing;
5555 (2) provide information on advanced technological
5656 systems for disaster construction engineering and other innovative
5757 solutions for addressing infrastructure risks;
5858 (3) provide information on banking and insurance
5959 requirements imposed following a disaster that may affect housing
6060 construction and recovery in areas affected by the disaster;
6161 (4) provide advice during disaster recovery on issues
6262 faced by state and local governments; and
6363 (5) propose solutions to address inefficiencies or
6464 problems in the state or local governmental disaster response with
6565 respect to issues described by this subsection.
6666 (h) The advisory council shall meet at the times and
6767 locations determined by the presiding officer, not to exceed four
6868 meetings each year.
6969 (i) Not later than November 1 of each even-numbered year,
7070 the advisory council shall submit a report on the advisory
7171 council's activities, advice, and proposed solutions to the
7272 commissioner, the Texas Division of Emergency Management, the
7373 governor, the lieutenant governor, and the speaker of the house of
7474 representatives.
7575 (j) The land office shall provide administrative support to
7676 the advisory council.
7777 (k) Chapter 2110, Government Code, does not apply to the
7878 advisory council.
7979 SECTION 2. As soon as practicable after the effective date
8080 of this Act, the commissioner of the General Land Office shall
8181 appoint to the business advisory council on disaster recovery and
8282 mitigation two members to terms expiring February 1, 2021, two
8383 members to terms expiring February 1, 2022, and two members to
8484 terms expiring February 1, 2023.
8585 SECTION 3. This Act takes effect September 1, 2019.
