66 AN ACT
77 relating to the creation of the Texas Mental Health Care
88 Consortium.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle E, Title 2, Health and Safety Code, is
1111 amended by adding Chapter 113 to read as follows:
1212 CHAPTER 113. TEXAS MENTAL HEALTH CARE CONSORTIUM
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 113.0001. DEFINITIONS. In this chapter:
1515 (1) "Community mental health provider" means an entity
1616 that provides mental health care services at a local level. The
1717 term includes community centers established under Subchapter A,
1818 Chapter 534.
1919 (2) "Consortium" means the Texas Mental Health Care
2020 Consortium.
2121 (3) "Executive committee" means the executive
2222 committee of the consortium.
2323 SUBCHAPTER B. CONSORTIUM
2424 Sec. 113.0051. ESTABLISHMENT; PURPOSE. The Texas Mental
2525 Health Care Consortium is established to:
2626 (1) coordinate the expansion and delivery of mental
2727 health care services by using the infrastructure and expertise of
2828 the health-related institutions of higher education listed in
2929 Section 113.0052 and community mental health providers;
3030 (2) enhance the state's ability to address mental
3131 health care needs through stronger collaboration and institutional
3232 alignment of the health-related institutions of higher education
3333 listed in Section 113.0052;
3434 (3) improve the effectiveness and efficiency of mental
3535 health care services delivered in this state;
3636 (4) facilitate access to mental health care services
3737 through telemedicine and other cost-effective, evidence-based
3838 programs;
3939 (5) improve mental health and substance use disorder
4040 research efforts conducted by institutions of higher education; and
4141 (6) improve and expand the behavioral health workforce
4242 through training and development opportunities between the
4343 health-related institutions of higher education listed in Section
4444 113.0052 and community mental health providers.
4545 Sec. 113.0052. COMPOSITION. The consortium is composed of:
4646 (1) the following health-related institutions of
4747 higher education:
4848 (A) Baylor College of Medicine;
4949 (B) The Texas A&M University System Health
5050 Science Center;
5151 (C) Texas Tech University Health Sciences
5252 Center;
5353 (D) Texas Tech University Health Sciences Center
5454 at El Paso;
5555 (E) University of North Texas Health Science
5656 Center at Fort Worth;
5757 (F) Dell Medical School at The University of
5858 Texas at Austin;
5959 (G) The University of Texas Medical Branch at
6060 Galveston;
6161 (H) The University of Texas Health Science Center
6262 at Houston;
6363 (I) The University of Texas Health Science Center
6464 at San Antonio;
6565 (J) The University of Texas Rio Grande Valley
6666 School of Medicine;
6767 (K) The University of Texas Health Science Center
6868 at Tyler; and
6969 (L) The University of Texas Southwestern Medical
7070 Center;
7171 (2) the commission;
7272 (3) not fewer than three nonprofit organizations that
7373 focus on mental health care; and
7474 (4) any other entity that the executive committee
7575 considers necessary.
7676 Sec. 113.0053. ADMINISTRATIVE ATTACHMENT. The consortium
7777 is administratively attached to the Texas Higher Education
7878 Coordinating Board. The Texas Higher Education Coordinating Board
7979 shall provide administrative support to the consortium as necessary
8080 to carry out the purposes of this chapter.
8181 SUBCHAPTER C. EXECUTIVE COMMITTEE
8282 Sec. 113.0101. EXECUTIVE COMMITTEE COMPOSITION. The
8383 consortium is governed by an executive committee composed of the
8484 following members:
8585 (1) the chair of the academic department of psychiatry
8686 of each of the health-related institutions of higher education
8787 listed in Section 113.0052;
8888 (2) a representative of the commission with expertise
8989 in the delivery of mental health care services, appointed by the
9090 executive commissioner;
9191 (3) a representative of the commission with expertise
9292 in mental health facilities, appointed by the executive
9393 commissioner;
9494 (4) a representative of an organization that
9595 represents the interests of community centers established under
9696 Subchapter A, Chapter 534, appointed by the governor;
9797 (5) a representative of each nonprofit organization
9898 described by Section 113.0052 that is part of the consortium,
9999 appointed by the governor; and
100100 (6) any other representative appointed by the governor
101101 at the request of the executive committee.
102102 Sec. 113.0102. PRESIDING OFFICER. The executive committee
103103 shall elect a presiding officer from among the membership of the
104104 executive committee.
105105 Sec. 113.0103. MEETINGS. The executive committee shall
106106 meet at the call of the presiding officer.
107107 Sec. 113.0104. VACANCY. A vacancy on the executive
108108 committee shall be filled in the same manner as the original
109109 appointment.
110110 Sec. 113.0105. GIFTS, GRANTS, AND DONATIONS. The executive
111111 committee may accept on behalf of the consortium gifts, grants, or
112112 donations from any public or private source for the purpose of
113113 carrying out this chapter.
114114 SUBCHAPTER D. POWERS AND DUTIES
115115 Sec. 113.0151. GENERAL DUTIES. (a) The executive
116116 committee shall:
117117 (1) coordinate the expansion and delivery of mental
118118 health care services by providing grants or other funding to the
119119 health-related institutions of higher education listed in Section
120120 113.0052 and community mental health providers;
121121 (2) establish procedures and policies for the
122122 administration of funds under this chapter;
123123 (3) monitor contracts and other agreements entered
124124 into under this chapter to ensure recipients of grants or other
125125 funding comply with the terms and conditions of those contracts or
126126 agreements; and
127127 (4) establish procedures to document compliance by
128128 executive committee members and staff with applicable laws
129129 governing conflicts of interest.
130130 (b) In carrying out the duties under Subsection (a), the
131131 consortium shall ensure that evidence-based tools, including
132132 telemedicine, are used to help expand the delivery of mental health
133133 care services.
134134 (c) The consortium shall designate a member of the executive
135135 committee to work in liaison with the statewide health coordinating
136136 council.
137137 Sec. 113.0152. COMPREHENSIVE CHILD PSYCHIATRY ACCESS
138138 NETWORK. (a) The consortium shall establish a network of
139139 comprehensive child psychiatry access centers at the
140140 health-related institutions of higher education listed in Section
141141 113.0052.
142142 (b) A center established under Subsection (a) shall
143143 collaborate with community mental health providers to better care
144144 for children and youth with behavioral health needs by:
145145 (1) providing consultation services and training
146146 opportunities for pediatricians and primary care providers
147147 operating in the center's geographic region; and
148148 (2) expanding a telemedicine program for identifying
149149 and assessing behavioral health needs and providing access to
150150 mental health care services.
151151 (c) A center established under Subsection (a) may enter into
152152 a memorandum of understanding with a community mental health
153153 provider to carry out this section.
154154 Sec. 113.0153. MENTAL HEALTH RESEARCH PLAN. The consortium
155155 shall:
156156 (1) develop and implement a mental health research
157157 plan to advance the research component of the statewide behavioral
158158 health strategic plan;
159159 (2) create an aggregated inventory of mental health
160160 and substance use disorder research completed by institutions of
161161 higher education in this state; and
162162 (3) coordinate mental health and substance use
163163 disorder research efforts by the health-related institutions of
164164 higher education listed in Section 113.0052 to ensure those
165165 institutions engage in effective and targeted research to leverage
166166 additional funding.
167167 Sec. 113.0154. BEHAVIORAL HEALTH WORKFORCE EXPANSION
168168 PROJECT. (a) The consortium shall enhance collaboration between
169169 the health-related institutions of higher education listed in
170170 Section 113.0052 and community mental health providers to increase
171171 psychiatric residency training and improve the quality of care for
172172 persons receiving mental health care services in this state.
173173 (b) The executive committee may provide grants or other
174174 funding to the academic department of psychiatry at each
175175 health-related institution of higher education listed in Section
176176 113.0052 for the purpose of funding:
177177 (1) one full-time psychiatrist to serve as academic
178178 medical director for a community mental health provider; and
179179 (2) two resident positions.
180180 (c) An academic medical director described by Subsection
181181 (b) shall collaborate and coordinate with community mental health
182182 providers to expand the amount and availability of mental health
183183 care resources by:
184184 (1) developing training opportunities for residents
185185 and medical students; and
186186 (2) promoting the use of telemedicine or other
187187 evidence-based tools to provide comprehensive mental health care
188188 services to a greater population.
189189 (d) An institution of higher education that receives grants
190190 or other funding under Subsection (b) shall include in its
191191 curriculum a requirement that psychiatric residents and medical
192192 students participate in rotations through facilities operated by
193193 community mental health providers.
194194 Sec. 113.0155. ANNUAL REPORT. Not later than July 31 of
195195 each year, the consortium shall submit to the governor, the
196196 lieutenant governor, the speaker of the house of representatives,
197197 and the standing committee of each house of the legislature with
198198 primary jurisdiction over behavioral health issues and post on its
199199 Internet website a written report that outlines:
200200 (1) the activities and objectives of the consortium;
201201 (2) the health-related institutions of higher
202202 education listed in Section 113.0052 or community mental health
203203 providers awarded grants or other funding by the executive
204204 committee;
205205 (3) any prospective grants or funding the consortium
206206 expects to receive; and
207207 (4) any research accomplishments associated with the
208208 consortium.
209209 SUBCHAPTER E. MISCELLANEOUS PROVISIONS
210210 Sec. 113.0201. JUDICIAL INSTRUCTION REGARDING MENTAL
211211 HEALTH CARE RESOURCES. The court of criminal appeals, in
212212 consultation with the consortium, shall develop a training program
213213 to educate and inform designated judges and their staff on mental
214214 health care resources available within the geographic region in
215215 which the designated judges preside. The court of criminal appeals
216216 may develop and operate the training program in conjunction with
217217 any other training programs it develops or operates.
218218 SECTION 2. As soon as practicable after the effective date
219219 of this Act, the governor and the executive commissioner of the
220220 Health and Human Services Commission shall make the appointments
221221 required by Section 113.0101, Health and Safety Code, as added by
222222 this Act.
223223 SECTION 3. This Act takes effect immediately if it receives
224224 a vote of two-thirds of all the members elected to each house, as
225225 provided by Section 39, Article III, Texas Constitution. If this
226226 Act does not receive the vote necessary for immediate effect, this
227227 Act takes effect September 1, 2019.
