46 AN ACT
57 relating to a common characteristic or use project in a public
68 improvement district in certain municipalities.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 372.0035(a), Local Government Code, is
911 amended to read as follows:
1012 (a) This section applies only to:
1113 (1) a municipality that:
1214 (A) has a population of more than 650,000 and
1315 less than two million; [or]
1416 (B) has a population of more than 325,000 and
1517 less than 625,000; or
1618 (C) has a population of more than 200,000 and
1719 less than 225,000; and
1820 (2) a public improvement district established under
1921 this subchapter and solely composed of territory in which the only
2022 businesses are:
2123 (A) hotels with 100 or more rooms ordinarily used
2224 for sleeping, if the district is established by a municipality
2325 described by Subdivision (1)(A); or
2426 (B) hotels with 75 or more rooms ordinarily used
2527 for sleeping, if the district is established by a municipality
2628 described by Subdivision (1)(B) or (C).
2729 SECTION 2. This Act takes effect immediately if it receives
2830 a vote of two-thirds of all the members elected to each house, as
2931 provided by Section 39, Article III, Texas Constitution. If this
3032 Act does not receive the vote necessary for immediate effect, this
3133 Act takes effect September 1, 2019.
