57 relating to approval for purchases of property or construction

810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subchapter F, Chapter 2165, Government Code, is
1012 amended by adding Section 2165.261 to read as follows:
1113 Sec. 2165.261. PROPERTY PURCHASES AND CONSTRUCTION
1214 PROJECTS BY SELF-DIRECTED SEMI-INDEPENDENT AGENCIES. (a) This
1315 section applies only to a state agency that has self-directed
1416 semi-independent status under state law.
1517 (b) Notwithstanding Chapter 472 of this code, Chapter 16,
1618 Finance Code, Chapter 1105, Occupations Code, or any law other than
1719 this subsection, a state agency must obtain written authorization
1820 from the governor before allocating money for the purchase of real
1921 property or to construct a building on real property. This
2022 subsection does not limit the authority of the legislature under
2123 other law to authorize construction projects or the purchase of
2224 real property.
2325 (c) To apply for authorization under this section, a state
2426 agency, in accordance with procedures prescribed by the governor,
2527 shall:
2628 (1) submit to the Texas Facilities Commission:
2729 (A) a detailed description of the proposed
2830 property purchase or construction project and the agency's need for
2931 the purchase or project; and
3032 (B) a request for an analysis by the commission
3133 of any available state property or building that satisfies the
3234 agency's need; and
3335 (2) submit to the governor:
3436 (A) a request for written authorization for the
3537 purchase or project that includes the detailed description
3638 submitted under Subdivision (1)(A), the total amount of money
3739 required to complete the purchase or project, and the agency's
3840 justification for the purchase or project; and
3941 (B) the analysis obtained from the commission
4042 under Subdivision (1)(B).
4143 (d) A state agency that receives written authorization
4244 under Subsection (c) shall:
4345 (1) collaborate with the Texas Facilities Commission
4446 with respect to the purchase or project; and
4547 (2) notify the commission and the General Land Office
4648 on completion of the purchase or project.
4749 (e) The governor may adopt rules necessary to implement this
4850 section.
4951 SECTION 2. (a) As soon as practicable after the effective
5052 date of this Act, the governor shall prescribe the procedures and
5153 may adopt any rules necessary to implement Section 2165.261,
5254 Government Code, as added by this Act. The governor may adopt the
5355 initial rules in the manner provided by law for emergency rules.
5456 (b) Not later than January 1, 2020, and in accordance with
5557 procedures prescribed by the governor, a state agency with
5658 self-directed semi-independent status under state law that before
5759 the effective date of this Act allocated money to purchase real
5860 property or construct a building on real property and has not
5961 completed the purchase or has not begun the construction, as
6062 applicable:
6163 (1) shall submit to the governor a detailed
6264 description of the proposed purchase or project, including the
6365 amount of money previously allocated by the agency for the purchase
6466 or project, the amount of money required to complete the purchase or
6567 project, and the agency's justification for the purchase or
6668 project; and
6769 (2) may not allocate additional money for the purchase
6870 or project unless the agency receives written authorization for the
6971 purchase or project from the governor in accordance with Section
7072 2165.261, Government Code, as added by this Act, and any rules
7173 adopted under that section.
7274 SECTION 3. This Act takes effect September 1, 2019.
