6	6	AN ACT
7	7	relating to the creation of the University of Houston College of
8	8	Medicine at the University of Houston.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 111, Education Code, is amended by
11	11	adding Subchapter K to read as follows:
12	12	SUBCHAPTER K. UNIVERSITY OF HOUSTON COLLEGE OF MEDICINE
13	13	Sec. 111.151. DEFINITIONS. In this subchapter:
14	14	(1) "Board" means the board of regents of the
15	15	University of Houston System.
16	16	(2) "College" means the University of Houston College
17	17	of Medicine established under this subchapter.
18	18	Sec. 111.152. THE UNIVERSITY OF HOUSTON COLLEGE OF
19	19	MEDICINE. The University of Houston College of Medicine is a
20	20	college of the University of Houston and is under the management and
21	21	control of the board with degrees offered under the name and
22	22	authority of the University of Houston.
23	23	Sec. 111.153. COURSES AND DEGREES. The board may prescribe
24	24	courses leading to customary degrees and may adopt rules for the
25	25	operation, control, and management of the college as necessary for
26	26	conducting a college of medicine of the first class.
27	27	Sec. 111.154. AFFILIATION AGREEMENTS. The dean of the
28	28	college, on behalf of the board, may execute and carry out an
29	29	affiliation or coordinating agreement with any other entity or
30	30	institution in the college's region.
31	31	Sec. 111.155. GIFTS AND GRANTS. The board may solicit,
32	32	accept, and administer gifts and grants from any public or private
33	33	source for the use and benefit of the college.
34	34	Sec. 111.156. OTHER FACILITIES. In addition to the
35	35	college's facilities, the board may enter into agreements under
36	36	which additional facilities used in the college's teaching and
37	37	research programs, including libraries, auditoriums, research
38	38	facilities, and medical education buildings, may be provided by a
39	39	public or private entity.
40	40	Sec. 111.157. TEACHING HOSPITAL. A teaching hospital
41	41	considered suitable by the board may be provided by a public or
42	42	private entity. The hospital may not be constructed, maintained, or
43	43	operated with state funds.
44	44	Sec. 111.158. ACCOUNTABILITY INFORMATION. Not later than
45	45	October 1 of each year, the college shall post on the college's
46	46	Internet website the following information regarding students
47	47	enrolled at the college:
48	48	(1) the percentage of students from groups that are
49	49	underrepresented in the practice of medicine, such as students from
50	50	racial or ethnic minority groups or students from an economically
51	51	disadvantaged background;
52	52	(2) the percentage of students who enroll in
53	53	coursework indicating a student focus in primary care or mental
54	54	health care; and
55	55	(3) whether the college has implemented a mandatory
56	56	clerkship or internship that requires each student to spend:
57	57	(A) not less than 60 days in a medically
58	58	underserved area during the student's enrollment, with priority
59	59	given to areas within a 10-mile radius of the college; and
60	60	(B) not less than an average of four hours each
61	61	week over a four-year period during the student's enrollment
62	62	serving in a primary health care clinic, such as a federally
63	63	qualified health center as defined by 42 U.S.C. Section
64	64	1396d(l)(2)(B), in Harris County or a county that is adjacent to
65	65	Harris County.
66	66	SECTION 2. Sections 59.01(1) and (3), Education Code, are
67	67	amended to read as follows:
68	68	(1) "Medical staff or students" means medical doctors,
69	69	doctors of osteopathy, dentists, veterinarians, and podiatrists
70	70	appointed to the faculty or professional medical staff employed for
71	71	student health services by The University of Texas System, The
72	72	Texas A&M University System, the Texas Tech University System, the
73	73	University of Houston College of Medicine, or the University of
74	74	North Texas Health Science Center at Fort Worth, either full time or
75	75	who, although appointed less than full time (including volunteers),
76	76	either devote their total professional service to such appointment
77	77	or provide services to patients by assignment from the department
78	78	chairman; and interns, residents, fellows, and medical or dental
79	79	students, veterinary students, and students of osteopathy
80	80	participating in a patient-care program in The University of Texas
81	81	System, The Texas A&M University System, the Texas Tech University
82	82	System, the University of Houston College of Medicine, or the
83	83	University of North Texas Health Science Center at Fort Worth.
84	84	(3) "Board" means the board of regents of The
85	85	University of Texas System, the board of regents of The Texas A&M
86	86	University System, the board of regents of the Texas Tech
87	87	University System, the board of regents of the University of
88	88	Houston System, or the board of regents of the University of North
89	89	Texas.
90	90	SECTION 3. Sections 59.02(a) and (c), Education Code, are
91	91	amended to read as follows:
92	92	(a) Each board may establish a separate self-insurance fund
93	93	to pay any damages adjudged in a court of competent jurisdiction or
94	94	a settlement of any medical malpractice claim against a member of
95	95	the medical staff or students arising from the exercise of the
96	96	member's [his] appointment, duties, or training with The University
97	97	of Texas System, The Texas A&M University System, the Texas Tech
98	98	University System, the University of Houston College of Medicine,
99	99	or the University of North Texas Health Science Center at Fort
100	100	Worth.
101	101	(c) On the establishment of each fund, transfers to the fund
102	102	shall be made in an amount and at such intervals as determined by
103	103	the board. Each board may receive and accept any gifts or
104	104	donations specified for the purposes of this subchapter and deposit
105	105	those gifts or donations into the fund. Each board may invest
106	106	money deposited in the fund, and any income received shall be
107	107	retained in the fund. The money shall be deposited in any of the
108	108	approved depository banks of The University of Texas System, The
109	109	Texas A&M University System, the Texas Tech University System, the
110	110	University of Houston System, or the University of North Texas
111	111	Health Science Center at Fort Worth. All expenditures from the
112	112	funds shall be paid pursuant to approval by the boards.
113	113	SECTION 4. Section 59.06, Education Code, is amended to
114	114	read as follows:
115	115	Sec. 59.06. LIMITATION ON APPROPRIATED FUNDS. Funds
116	116	appropriated by the legislature to either system, to the Texas Tech
117	117	University Health Sciences Center, to the Texas Tech University
118	118	Health Sciences Center at El Paso, to the University of Houston for
119	119	the University of Houston College of Medicine, or to the University
120	120	of North Texas Health Science Center at Fort Worth from the General
121	121	Revenue Fund may not be used to establish or maintain the fund, to
122	122	purchase insurance, or to employ private legal counsel.
123	123	SECTION 5. Section 61.003(5), Education Code, is amended to
124	124	read as follows:
125	125	(5) "Medical and dental unit" means The Texas A&M
126	126	University System Health Science Center and its component
127	127	institutions, agencies, and programs; the Texas Tech University
128	128	Health Sciences Center; the Texas Tech University Health Sciences
129	129	Center at El Paso; the University of Houston College of Medicine;
130	130	The University of Texas Medical Branch at Galveston; The University
131	131	of Texas Southwestern Medical Center; The University of Texas
132	132	Medical School at San Antonio; The University of Texas Dental
133	133	Branch at Houston; The University of Texas M. D. Anderson Cancer
134	134	Center; The University of Texas Graduate School of Biomedical
135	135	Sciences at Houston; The University of Texas Dental School at San
136	136	Antonio; The University of Texas Medical School at Houston; The
137	137	University of Texas Health Science Center--South Texas and its
138	138	component institutions, if established under Subchapter N, Chapter
139	139	74; the nursing institutions of The Texas A&M University System and
140	140	The University of Texas System; and The University of Texas School
141	141	of Public Health at Houston; and such other medical or dental
142	142	schools as may be established by statute or as provided in this
143	143	chapter.
144	144	SECTION 6. Section 61.501(1), Education Code, is amended to
145	145	read as follows:
146	146	(1) "Medical school" means the medical school at The
147	147	University of Texas Health Science Center at Houston, the medical
148	148	school at The University of Texas Southwestern Medical Center, the
149	149	medical school at The University of Texas Health Science Center at
150	150	San Antonio, The University of Texas Medical Branch at Galveston,
151	151	the medical school at The University of Texas at Austin, the medical
152	152	school at The University of Texas Rio Grande Valley, the medical
153	153	education program of The University of Texas Health Science Center
154	154	at Tyler, the medical school at the Texas Tech University Health
155	155	Sciences Center, the medical school at the Texas Tech University
156	156	Health Sciences Center at El Paso, the University of Houston
157	157	College of Medicine, the Baylor College of Medicine, the college of
158	158	osteopathic medicine at the University of North Texas Health
159	159	Science Center at Fort Worth, or the medical school at the Texas A&M
160	160	University Health Science Center.
161	161	SECTION 7. Section 63.002(c), Education Code, is amended to
162	162	read as follows:
163	163	(c) The amount available for distribution from the fund may
164	164	be appropriated only for programs that benefit medical research,
165	165	health education, or treatment programs at the following
166	166	health-related institutions of higher education:
167	167	(1) The University of Texas Health Science Center at
168	168	San Antonio;
169	169	(2) The University of Texas M. D. Anderson Cancer
170	170	Center;
171	171	(3) The University of Texas Southwestern Medical
172	172	Center;
173	173	(4) The University of Texas Medical Branch at
174	174	Galveston;
175	175	(5) The University of Texas Health Science Center at
176	176	Houston;
177	177	(6) The University of Texas Health Science Center at
178	178	Tyler;
179	179	(7) The University of Texas Health Science
180	180	Center--South Texas and its component institutions, if established
181	181	under Subchapter N, Chapter 74;
182	182	(8) The Texas A&M University Health Science Center;
183	183	(9) the University of North Texas Health Science
184	184	Center at Fort Worth;
185	185	(10) the Texas Tech University Health Sciences Center;
186	186	(11) the Texas Tech University Health Sciences Center
187	187	at El Paso; [and]
188	188	(12) the University of Houston College of Medicine;
189	189	and
190	190	(13) Baylor College of Medicine, if a contract between
191	191	Baylor College of Medicine and the Texas Higher Education
192	192	Coordinating Board is in effect under Section 61.092.
193	193	SECTION 8. Not later than October 1, 2020, the University of
194	194	Houston College of Medicine shall post on the college's Internet
195	195	website the initial information required under Section 111.158,
196	196	Education Code, as added by this Act.
197	197	SECTION 9. This Act takes effect immediately if it receives
198	198	a vote of two-thirds of all the members elected to each house, as
199	199	provided by Section 39, Article III, Texas Constitution. If this
200	200	Act does not receive the vote necessary for immediate effect, this
201	201	Act takes effect September 1, 2019.
