55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of the University of Houston College of
88 Medicine at the University of Houston.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 111, Education Code, is amended by
1111 adding Subchapter K to read as follows:
1212 SUBCHAPTER K. UNIVERSITY OF HOUSTON COLLEGE OF MEDICINE
1313 Sec. 111.151. DEFINITIONS. In this subchapter:
1414 (1) "Board" means the board of regents of the
1515 University of Houston System.
1616 (2) "College" means the University of Houston College
1717 of Medicine established under this subchapter.
1818 Sec. 111.152. THE UNIVERSITY OF HOUSTON COLLEGE OF
1919 MEDICINE. The University of Houston College of Medicine is a
2020 college of the University of Houston and is under the management and
2121 control of the board with degrees offered under the name and
2222 authority of the University of Houston.
2323 Sec. 111.153. COURSES AND DEGREES. The board may prescribe
2424 courses leading to customary degrees and may adopt rules for the
2525 operation, control, and management of the college as necessary for
2626 conducting a college of medicine of the first class.
2727 Sec. 111.154. AFFILIATION AGREEMENTS. The dean of the
2828 college, on behalf of the board, may execute and carry out an
2929 affiliation or coordinating agreement with any other entity or
3030 institution in the college's region.
3131 Sec. 111.155. GIFTS AND GRANTS. The board may solicit,
3232 accept, and administer gifts and grants from any public or private
3333 source for the use and benefit of the college.
3434 Sec. 111.156. OTHER FACILITIES. In addition to the
3535 college's facilities, the board may enter into agreements under
3636 which additional facilities used in the college's teaching and
3737 research programs, including libraries, auditoriums, research
3838 facilities, and medical education buildings, may be provided by a
3939 public or private entity.
4040 Sec. 111.157. TEACHING HOSPITAL. A teaching hospital
4141 considered suitable by the board may be provided by a public or
4242 private entity. The hospital may not be constructed, maintained, or
4343 operated with state funds.
4444 Sec. 111.158. ACCOUNTABILITY INFORMATION. Not later than
4545 October 1 of each year, the college shall post on the college's
4646 Internet website the following information regarding students
4747 enrolled at the college:
4848 (1) the percentage of students from groups that are
4949 underrepresented in the practice of medicine, such as students from
5050 racial or ethnic minority groups or students from an economically
5151 disadvantaged background;
5252 (2) the percentage of students who enroll in
5353 coursework indicating a student focus in primary care or mental
5454 health care; and
5555 (3) whether the college has implemented a mandatory
5656 clerkship or internship that requires each student to spend:
5757 (A) not less than 60 days in a medically
5858 underserved area during the student's enrollment, with priority
5959 given to areas within a 10-mile radius of the college; and
6060 (B) not less than an average of four hours each
6161 week over a four-year period during the student's enrollment
6262 serving in a primary health care clinic, such as a federally
6363 qualified health center as defined by 42 U.S.C. Section
6464 1396d(l)(2)(B), in Harris County or a county that is adjacent to
6565 Harris County.
6666 SECTION 2. Sections 59.01(1) and (3), Education Code, are
6767 amended to read as follows:
6868 (1) "Medical staff or students" means medical doctors,
6969 doctors of osteopathy, dentists, veterinarians, and podiatrists
7070 appointed to the faculty or professional medical staff employed for
7171 student health services by The University of Texas System, The
7272 Texas A&M University System, the Texas Tech University System, the
7373 University of Houston College of Medicine, or the University of
7474 North Texas Health Science Center at Fort Worth, either full time or
7575 who, although appointed less than full time (including volunteers),
7676 either devote their total professional service to such appointment
7777 or provide services to patients by assignment from the department
7878 chairman; and interns, residents, fellows, and medical or dental
7979 students, veterinary students, and students of osteopathy
8080 participating in a patient-care program in The University of Texas
8181 System, The Texas A&M University System, the Texas Tech University
8282 System, the University of Houston College of Medicine, or the
8383 University of North Texas Health Science Center at Fort Worth.
8484 (3) "Board" means the board of regents of The
8585 University of Texas System, the board of regents of The Texas A&M
8686 University System, the board of regents of the Texas Tech
8787 University System, the board of regents of the University of
8888 Houston System, or the board of regents of the University of North
8989 Texas.
9090 SECTION 3. Sections 59.02(a) and (c), Education Code, are
9191 amended to read as follows:
9292 (a) Each board may establish a separate self-insurance fund
9393 to pay any damages adjudged in a court of competent jurisdiction or
9494 a settlement of any medical malpractice claim against a member of
9595 the medical staff or students arising from the exercise of the
9696 member's [his] appointment, duties, or training with The University
9797 of Texas System, The Texas A&M University System, the Texas Tech
9898 University System, the University of Houston College of Medicine,
9999 or the University of North Texas Health Science Center at Fort
100100 Worth.
101101 (c) On the establishment of each fund, transfers to the fund
102102 shall be made in an amount and at such intervals as determined by
103103 the board. Each board may receive and accept any gifts or
104104 donations specified for the purposes of this subchapter and deposit
105105 those gifts or donations into the fund. Each board may invest
106106 money deposited in the fund, and any income received shall be
107107 retained in the fund. The money shall be deposited in any of the
108108 approved depository banks of The University of Texas System, The
109109 Texas A&M University System, the Texas Tech University System, the
110110 University of Houston System, or the University of North Texas
111111 Health Science Center at Fort Worth. All expenditures from the
112112 funds shall be paid pursuant to approval by the boards.
113113 SECTION 4. Section 59.06, Education Code, is amended to
114114 read as follows:
115115 Sec. 59.06. LIMITATION ON APPROPRIATED FUNDS. Funds
116116 appropriated by the legislature to either system, to the Texas Tech
117117 University Health Sciences Center, to the Texas Tech University
118118 Health Sciences Center at El Paso, to the University of Houston for
119119 the University of Houston College of Medicine, or to the University
120120 of North Texas Health Science Center at Fort Worth from the General
121121 Revenue Fund may not be used to establish or maintain the fund, to
122122 purchase insurance, or to employ private legal counsel.
123123 SECTION 5. Section 61.003(5), Education Code, is amended to
124124 read as follows:
125125 (5) "Medical and dental unit" means The Texas A&M
126126 University System Health Science Center and its component
127127 institutions, agencies, and programs; the Texas Tech University
128128 Health Sciences Center; the Texas Tech University Health Sciences
129129 Center at El Paso; the University of Houston College of Medicine;
130130 The University of Texas Medical Branch at Galveston; The University
131131 of Texas Southwestern Medical Center; The University of Texas
132132 Medical School at San Antonio; The University of Texas Dental
133133 Branch at Houston; The University of Texas M. D. Anderson Cancer
134134 Center; The University of Texas Graduate School of Biomedical
135135 Sciences at Houston; The University of Texas Dental School at San
136136 Antonio; The University of Texas Medical School at Houston; The
137137 University of Texas Health Science Center--South Texas and its
138138 component institutions, if established under Subchapter N, Chapter
139139 74; the nursing institutions of The Texas A&M University System and
140140 The University of Texas System; and The University of Texas School
141141 of Public Health at Houston; and such other medical or dental
142142 schools as may be established by statute or as provided in this
143143 chapter.
144144 SECTION 6. Section 61.501(1), Education Code, is amended to
145145 read as follows:
146146 (1) "Medical school" means the medical school at The
147147 University of Texas Health Science Center at Houston, the medical
148148 school at The University of Texas Southwestern Medical Center, the
149149 medical school at The University of Texas Health Science Center at
150150 San Antonio, The University of Texas Medical Branch at Galveston,
151151 the medical school at The University of Texas at Austin, the medical
152152 school at The University of Texas Rio Grande Valley, the medical
153153 education program of The University of Texas Health Science Center
154154 at Tyler, the medical school at the Texas Tech University Health
155155 Sciences Center, the medical school at the Texas Tech University
156156 Health Sciences Center at El Paso, the University of Houston
157157 College of Medicine, the Baylor College of Medicine, the college of
158158 osteopathic medicine at the University of North Texas Health
159159 Science Center at Fort Worth, or the medical school at the Texas A&M
160160 University Health Science Center.
161161 SECTION 7. Section 63.002(c), Education Code, is amended to
162162 read as follows:
163163 (c) The amount available for distribution from the fund may
164164 be appropriated only for programs that benefit medical research,
165165 health education, or treatment programs at the following
166166 health-related institutions of higher education:
167167 (1) The University of Texas Health Science Center at
168168 San Antonio;
169169 (2) The University of Texas M. D. Anderson Cancer
170170 Center;
171171 (3) The University of Texas Southwestern Medical
172172 Center;
173173 (4) The University of Texas Medical Branch at
174174 Galveston;
175175 (5) The University of Texas Health Science Center at
176176 Houston;
177177 (6) The University of Texas Health Science Center at
178178 Tyler;
179179 (7) The University of Texas Health Science
180180 Center--South Texas and its component institutions, if established
181181 under Subchapter N, Chapter 74;
182182 (8) The Texas A&M University Health Science Center;
183183 (9) the University of North Texas Health Science
184184 Center at Fort Worth;
185185 (10) the Texas Tech University Health Sciences Center;
186186 (11) the Texas Tech University Health Sciences Center
187187 at El Paso; [and]
188188 (12) the University of Houston College of Medicine;
189189 and
190190 (13) Baylor College of Medicine, if a contract between
191191 Baylor College of Medicine and the Texas Higher Education
192192 Coordinating Board is in effect under Section 61.092.
193193 SECTION 8. Not later than October 1, 2020, the University of
194194 Houston College of Medicine shall post on the college's Internet
195195 website the initial information required under Section 111.158,
196196 Education Code, as added by this Act.
197197 SECTION 9. This Act takes effect immediately if it receives
198198 a vote of two-thirds of all the members elected to each house, as
199199 provided by Section 39, Article III, Texas Constitution. If this
200200 Act does not receive the vote necessary for immediate effect, this
201201 Act takes effect September 1, 2019.
