55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the transition and employment guide for public school
88 students enrolled in a special education program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.0112(b), Education Code, is amended
1111 to read as follows:
1212 (b) The transition and employment guide must be written in
1313 plain language and contain information specific to this state
1414 regarding:
1515 (1) transition services;
1616 (2) employment and supported employment services;
1717 (3) social security programs, including the Ticket to
1818 Work Program authorized by the Ticket to Work and Work Incentives
1919 Improvement Act of 1999 (Pub. L. No. 106-170);
2020 (4) community and long-term services and support,
2121 including the option to place the student on a waiting list with a
2222 governmental agency for public benefits available to the student,
2323 such as a waiver program established under Section 1915(c), Social
2424 Security Act (42 U.S.C. Section 1396n(c));
2525 (5) postsecondary educational programs and services,
2626 including the inventory maintained by the Texas Higher Education
2727 Coordinating Board under Section 61.0663;
2828 (6) information sharing with health and human services
2929 agencies and providers;
3030 (7) guardianship and alternatives to guardianship,
3131 including a supported decision-making agreement under Chapter
3232 1357, Estates Code;
3333 (8) self-advocacy, person-directed planning, and
3434 self-determination; [and]
3535 (9) contact information for all relevant state
3636 agencies;
3737 (10) financial literacy, including information and
3838 curricula on the effective long-term management of financial
3939 resources; and
4040 (11) financial independence, including:
4141 (A) special needs trusts;
4242 (B) the Texas Achieving a Better Life Experience
4343 (ABLE) Program under Subchapter J, Chapter 54, authorized under
4444 Section 529A, Internal Revenue Code of 1986;
4545 (C) the Medicaid buy-in programs implemented
4646 under Section 531.02444, Government Code; and
4747 (D) other work incentive programs.
4848 SECTION 2. This Act applies beginning with the 2020-2021
4949 school year.
5050 SECTION 3. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2019.
