9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 521.457(e), Transportation Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (e) Except as provided by Subsections [(f),] (f-1)[,] and | |
13 | 13 | (f-2), an offense under this section is a Class C misdemeanor. | |
14 | 14 | SECTION 2. Section 521.457(f), Transportation Code, is | |
15 | 15 | repealed. | |
16 | 16 | SECTION 3. The change in law made by this Act applies only | |
17 | 17 | to an offense committed on or after the effective date of this Act. | |
18 | 18 | An offense committed before the effective date of this Act is | |
19 | 19 | governed by the law in effect on the date the offense was committed, | |
20 | 20 | and the former law is continued in effect for that purpose. For | |
21 | 21 | purposes of this section, an offense was committed before the | |
22 | 22 | effective date of this Act if any element of the offense occurred | |
23 | 23 | before that date. | |
24 | 24 | SECTION 4. This Act takes effect September 1, 2019. |
