| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Sections 8871.024(a) and (e), Special District |
|---|
| 9 | 11 | | Local Laws Code, are amended to read as follows: |
|---|
| 10 | 12 | | (a) The temporary directors shall order an election in the |
|---|
| 11 | 13 | | district, to be held not later than the uniform election date in |
|---|
| 12 | 14 | | November 2019 [May 2018], to confirm the creation of the district |
|---|
| 13 | 15 | | and to elect the initial directors. |
|---|
| 14 | 16 | | (e) If the district's creation is not confirmed at an |
|---|
| 15 | 17 | | election held under Subsection (a), the candidate who receives a |
|---|
| 16 | 18 | | majority of the votes cast at that election for each of the seven |
|---|
| 17 | 19 | | positions on the board becomes a temporary director of the |
|---|
| 18 | 20 | | district. The temporary directors elected under this subsection |
|---|
| 19 | 21 | | shall order a subsequent election to be held to confirm the creation |
|---|
| 20 | 22 | | of the district and to elect the initial directors not earlier than |
|---|
| 21 | 23 | | the uniform election date in November [May] 2020. |
|---|
| 22 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 28 | | Act takes effect September 1, 2019. |
