| 9 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 9 | | SECTION 1. Section 552.053, Local Government Code, is |
|---|
| 11 | 10 | | amended by amending Subsection (b) and adding Subsections (b-1) and |
|---|
| 12 | 11 | | (b-2) to read as follows: |
|---|
| 13 | 12 | | (b) The following may be exempt: |
|---|
| 14 | 13 | | (1) this state; |
|---|
| 15 | 14 | | (2) a county; |
|---|
| 16 | 15 | | (3) a municipality; or |
|---|
| 17 | 16 | | (4) [a] school districts and open-enrollment charter |
|---|
| 18 | 17 | | schools [district]. |
|---|
| 19 | 18 | | (b-1) For purposes of an exemption granted under Subsection |
|---|
| 20 | 19 | | (b)(4), the exemption must be granted to both school districts and |
|---|
| 21 | 20 | | open-enrollment charter schools. |
|---|
| 22 | 21 | | (b-2) For purposes of this section, an "open-enrollment |
|---|
| 23 | 22 | | charter school" means a school granted a charter under Subchapter D |
|---|
| 24 | 23 | | or E, Chapter 12, Education Code. |
|---|
| 25 | 24 | | SECTION 2. An exemption granted to a school district under |
|---|
| 26 | 25 | | Section 552.053(b)(4), Local Government Code, as that section |
|---|
| 27 | 26 | | existed before the effective date of this Act, automatically |
|---|
| 28 | 27 | | extends to all open-enrollment charter schools located in the |
|---|
| 29 | 28 | | municipality after the effective date of this Act unless the |
|---|
| 30 | 29 | | municipality repeals the exemption before the effective date of |
|---|
| 31 | 30 | | this Act. |
|---|
| 32 | 31 | | SECTION 3. This Act takes effect September 1, 2019. |
