55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a code enforcement officer to possess
88 or carry an instrument used for deterring an animal bite.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.15, Penal Code, is amended by adding
1111 Subsection (h) to read as follows:
1212 (h) The provisions of Sections 46.02 and 46.03 prohibiting
1313 the possession or carrying of a club do not apply to a code
1414 enforcement officer who:
1515 (1) holds a certificate of registration issued under
1616 Chapter 1952, Occupations Code; and
1717 (2) possesses or carries an instrument used
1818 specifically for deterring an animal bite while the officer is:
1919 (A) performing official duties; or
2020 (B) traveling to or from a place of duty.
2121 SECTION 2. Section 1952.051, Occupations Code, is amended
2222 by adding Subsection (c) to read as follows:
2323 (c) The education requirements adopted under Subsection (b)
2424 must include education regarding the principles and procedures for
2525 a code enforcement officer to follow when possessing or carrying an
2626 instrument used specifically for deterring an animal bite.
2727 SECTION 3. Section 1952.1051, Occupations Code, is amended
2828 to read as follows:
2929 Sec. 1952.1051. CONTINUING EDUCATION. The commission by
3030 rule shall prescribe continuing education requirements for code
3131 enforcement officers and code enforcement officers in training
3232 that:
3333 (1) establish the number of hours of continuing
3434 education required for renewal of a certificate of registration;
3535 (2) establish an approved curriculum that includes
3636 material regarding changes in applicable law and the principles and
3737 procedures to follow when possessing or carrying an instrument used
3838 specifically for deterring an animal bite; and
3939 (3) provide that the approved curriculum may be taught
4040 by suitable public agencies and by private entities approved by the
4141 department.
4242 SECTION 4. This Act takes effect September 1, 2019.
