55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the certification of an area's wet or dry status for the
88 purpose of an alcoholic beverage permit or license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 11.37(a), (b), and (d), Alcoholic
1111 Beverage Code, are amended to read as follows:
1212 (a) Not later than the 30th day after the date a prospective
1313 applicant for a permit issued by the commission requests
1414 certification, the [The] county clerk of the county in which the
1515 request [an application for a permit] is made shall certify whether
1616 the location or address given in the request [application] is in a
1717 wet area and whether the sale of alcoholic beverages for which the
1818 permit is sought is prohibited by any valid order of the
1919 commissioners court.
2020 (b) Not later than the 30th day after the date a prospective
2121 applicant for a permit issued by the commission requests
2222 certification, the [The] city secretary or clerk of the city in
2323 which the request [an application for a permit] is made shall
2424 certify whether the location or address given in the request
2525 [application] is in a wet area and whether the sale of alcoholic
2626 beverages for which the permit is sought is prohibited by charter or
2727 ordinance.
2828 (d) Notwithstanding any other provision of this code, if the
2929 county clerk, city secretary, or city clerk certifies that the
3030 location or address given in the request [application] is not in a
3131 wet area or refuses to issue the certification required by this
3232 section, the prospective applicant is entitled to a hearing before
3333 the county judge to contest the certification or refusal to
3434 certify. The prospective applicant must submit a written request
3535 to the county judge for a hearing under this subsection. The
3636 county judge shall conduct a hearing required by this subsection
3737 not later than the 30th day after the date the county judge receives
3838 the written request.
3939 SECTION 2. Sections 61.37(a), (b), and (d), Alcoholic
4040 Beverage Code, are amended to read as follows:
4141 (a) Not later than the 30th day after the date a prospective
4242 applicant for a license issued by the commission requests
4343 certification, the [The] county clerk of the county in which the
4444 request [an application for a license] is made shall certify
4545 whether the location or address given in the request [application]
4646 is in a wet area and whether the sale of alcoholic beverages for
4747 which the license is sought is prohibited by any valid order of the
4848 commissioners court.
4949 (b) Not later than the 30th day after the date a prospective
5050 applicant for a license issued by the commission requests
5151 certification, the [The] city secretary or clerk of the city in
5252 which the request [an application for a license] is made shall
5353 certify whether the location or address given in the request
5454 [application] is in a wet area and whether the sale of alcoholic
5555 beverages for which the license is sought is prohibited by charter
5656 or ordinance.
5757 (d) Notwithstanding any other provision of this code, if the
5858 county clerk, city secretary, or city clerk certifies that the
5959 location or address given in the request [application] is not in a
6060 wet area or refuses to issue the certification required by this
6161 section, the prospective applicant is entitled to a hearing before
6262 the county judge to contest the certification or refusal to
6363 certify. The prospective applicant must submit a written request
6464 to the county judge for a hearing under this subsection. The county
6565 judge shall conduct a hearing required by this subsection not later
6666 than the 30th day after the date the county judge receives the
6767 written request.
6868 SECTION 3. Sections 11.37 and 61.37, Alcoholic Beverage
6969 Code, as amended by this Act, apply only to an application for a
7070 permit or license received on or after the effective date of this
7171 Act. An application for a permit or license received before the
7272 effective date of this Act is governed by the law in effect
7373 immediately before the effective date of this Act, and that law is
7474 continued in effect for that purpose.
7575 SECTION 4. This Act takes effect September 1, 2019.
