| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Subchapter A, Chapter 531, Government Code, is |
|---|
| 10 | 12 | | amended by adding Section 531.0084 to read as follows: |
|---|
| 11 | 13 | | Sec. 531.0084. INVESTIGATION UNIT FOR ILLEGALLY OPERATING |
|---|
| 12 | 14 | | CHILD-CARE FACILITIES. The executive commissioner shall maintain a |
|---|
| 13 | 15 | | unit within the child-care licensing division of the commission |
|---|
| 14 | 16 | | consisting of investigators whose primary responsibility is to: |
|---|
| 15 | 17 | | (1) identify child-care facilities that are operating |
|---|
| 16 | 18 | | without a license, certification, registration, or listing |
|---|
| 17 | 19 | | required by Chapter 42, Human Resources Code; and |
|---|
| 18 | 20 | | (2) initiate appropriate enforcement actions against |
|---|
| 19 | 21 | | those facilities. |

| 20 | 22 | | SECTION 2. As soon as possible after the effective date of |
|---|
| 21 | 23 | | this Act, the executive commissioner of the Health and Human |
|---|
| 22 | 24 | | Services Commission shall establish the investigation unit |
|---|
| 23 | 25 | | required by Section 531.0084, Government Code, as added by this |
|---|
| 24 | 26 | | Act. |
|---|
| 25 | 27 | | SECTION 3. This Act takes effect September 1, 2019. |
