| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 382.202, Health and Safety Code, is |
|---|
| 9 | 11 | | amended by adding Subsection (d-1) to read as follows: |
|---|
| 10 | 12 | | (d-1) The commission may adopt rules providing for the |
|---|
| 11 | 13 | | inclusion on a vehicle inspection report for a vehicle inspected in |
|---|
| 12 | 14 | | a county that is included in a vehicle emissions inspection and |
|---|
| 13 | 15 | | maintenance program under Subchapter F, Chapter 548, |
|---|
| 14 | 16 | | Transportation Code, of notification regarding whether the vehicle |
|---|
| 15 | 17 | | is subject to a safety recall for which the vehicle has not been |
|---|
| 16 | 18 | | repaired or the repairs are incomplete. The commission may accept |
|---|
| 17 | 19 | | gifts, grants, and donations from any source, including private and |
|---|
| 18 | 20 | | nonprofit organizations, for the purpose of providing the |
|---|
| 19 | 21 | | notification described by this subsection. |

| 20 | 22 | | SECTION 2. Section 548.252, Transportation Code, is amended |
|---|
| 21 | 23 | | by adding Subsection (c) to read as follows: |
|---|
| 22 | 24 | | (c) The department may adopt rules providing for the |
|---|
| 23 | 25 | | inclusion on a vehicle inspection report for a vehicle inspected |
|---|
| 24 | 26 | | under this chapter notification regarding whether the vehicle is |
|---|
| 25 | 27 | | subject to a safety recall for which the vehicle has not been |
|---|
| 26 | 28 | | repaired or the repairs are incomplete. The department may accept |
|---|
| 27 | 29 | | gifts, grants, and donations from any source, including private and |
|---|
| 28 | 30 | | nonprofit organizations, for the purpose of providing the |
|---|
| 29 | 31 | | notification described by this subsection. |
|---|
| 30 | 32 | | SECTION 3. The Texas Commission on Environmental Quality |
|---|
| 31 | 33 | | and the Department of Public Safety of the State of Texas are |
|---|
| 32 | 34 | | required to implement a provision of this Act, as applicable, only |
|---|
| 33 | 35 | | if the legislature appropriates money specifically for that |
|---|
| 34 | 36 | | purpose. If the legislature does not appropriate money |
|---|
| 35 | 37 | | specifically for that purpose, the commission and the department |
|---|
| 36 | 38 | | may, but are not required to, implement a provision of this Act, as |
|---|
| 37 | 39 | | applicable, using other appropriations available for that purpose. |
|---|
| 38 | 40 | | SECTION 4. This Act takes effect September 1, 2019. |
