46 AN ACT
57 relating to allowing safety recall information to be included in a
68 vehicle inspection report.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 382.202, Health and Safety Code, is
911 amended by adding Subsection (d-1) to read as follows:
1012 (d-1) The commission may adopt rules providing for the
1113 inclusion on a vehicle inspection report for a vehicle inspected in
1214 a county that is included in a vehicle emissions inspection and
1315 maintenance program under Subchapter F, Chapter 548,
1416 Transportation Code, of notification regarding whether the vehicle
1517 is subject to a safety recall for which the vehicle has not been
1618 repaired or the repairs are incomplete. The commission may accept
1719 gifts, grants, and donations from any source, including private and
1820 nonprofit organizations, for the purpose of providing the
1921 notification described by this subsection.
2022 SECTION 2. Section 548.252, Transportation Code, is amended
2123 by adding Subsection (c) to read as follows:
2224 (c) The department may adopt rules providing for the
2325 inclusion on a vehicle inspection report for a vehicle inspected
2426 under this chapter notification regarding whether the vehicle is
2527 subject to a safety recall for which the vehicle has not been
2628 repaired or the repairs are incomplete. The department may accept
2729 gifts, grants, and donations from any source, including private and
2830 nonprofit organizations, for the purpose of providing the
2931 notification described by this subsection.
3032 SECTION 3. The Texas Commission on Environmental Quality
3133 and the Department of Public Safety of the State of Texas are
3234 required to implement a provision of this Act, as applicable, only
3335 if the legislature appropriates money specifically for that
3436 purpose. If the legislature does not appropriate money
3537 specifically for that purpose, the commission and the department
3638 may, but are not required to, implement a provision of this Act, as
3739 applicable, using other appropriations available for that purpose.
3840 SECTION 4. This Act takes effect September 1, 2019.
