55 AN ACT
66 relating to the statute of limitations for certain sexual assault
77 offenses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 12, Code of Criminal Procedure, is
1010 amended by adding Article 12.051 to read as follows:
1111 Art. 12.051. TOLLING OF LIMITATION PERIOD IN CERTAIN SEXUAL
1212 ASSAULT CASES. (a) This article applies only to sexual assault
1313 under Section 22.011, Penal Code, and aggravated sexual assault
1414 under Section 22.021, Penal Code.
1515 (b) If biological matter is collected during the
1616 investigation of an offense to which this article applies, the
1717 running of the period of limitation for the offense is tolled from
1818 the date on which the biological matter is first collected until the
1919 date on which forensic DNA testing results show that all DNA
2020 profiles derived from the matter match one or more persons, all of
2121 whose identities are readily ascertained.
2222 SECTION 2. Article 12.01, Code of Criminal Procedure, is
2323 amended to read as follows:
2424 Art. 12.01. FELONIES. Except as provided in Article 12.03,
2525 felony indictments may be presented within these limits, and not
2626 afterward:
2727 (1) no limitation:
2828 (A) murder and manslaughter;
2929 (B) sexual assault under Section 22.011(a)(2),
3030 Penal Code, or aggravated sexual assault under Section
3131 22.021(a)(1)(B), Penal Code;
3232 (C) sexual assault, if[:
3333 [(i) during the investigation of the
3434 offense biological matter is collected and subjected to forensic
3535 DNA testing and the testing results show that the matter does not
3636 match the victim or any other person whose identity is readily
3737 ascertained; or
3838 [(ii)] probable cause exists to believe
3939 that the defendant has committed the same or a similar sexual
4040 offense against five or more victims;
4141 (D) continuous sexual abuse of young child or
4242 children under Section 21.02, Penal Code;
4343 (E) indecency with a child under Section 21.11,
4444 Penal Code;
4545 (F) an offense involving leaving the scene of an
4646 accident under Section 550.021, Transportation Code, if the
4747 accident resulted in the death of a person;
4848 (G) trafficking of persons under Section
4949 20A.02(a)(7) or (8), Penal Code;
5050 (H) continuous trafficking of persons under
5151 Section 20A.03, Penal Code; or
5252 (I) compelling prostitution under Section
5353 43.05(a)(2), Penal Code;
5454 (2) ten years from the date of the commission of the
5555 offense:
5656 (A) theft of any estate, real, personal or mixed,
5757 by an executor, administrator, guardian or trustee, with intent to
5858 defraud any creditor, heir, legatee, ward, distributee,
5959 beneficiary or settlor of a trust interested in such estate;
6060 (B) theft by a public servant of government
6161 property over which he exercises control in his official capacity;
6262 (C) forgery or the uttering, using or passing of
6363 forged instruments;
6464 (D) injury to an elderly or disabled individual
6565 punishable as a felony of the first degree under Section 22.04,
6666 Penal Code;
6767 (E) sexual assault, except as provided by
6868 Subdivision (1);
6969 (F) arson;
7070 (G) trafficking of persons under Section
7171 20A.02(a)(1), (2), (3), or (4), Penal Code; or
7272 (H) compelling prostitution under Section
7373 43.05(a)(1), Penal Code;
7474 (3) seven years from the date of the commission of the
7575 offense:
7676 (A) misapplication of fiduciary property or
7777 property of a financial institution;
7878 (B) securing execution of document by deception;
7979 (C) a felony violation under Chapter 162, Tax
8080 Code;
8181 (D) false statement to obtain property or credit
8282 under Section 32.32, Penal Code;
8383 (E) money laundering;
8484 (F) credit card or debit card abuse under Section
8585 32.31, Penal Code;
8686 (G) fraudulent use or possession of identifying
8787 information under Section 32.51, Penal Code;
8888 (H) exploitation of a child, elderly individual,
8989 or disabled individual under Section 32.53, Penal Code;
9090 (I) Medicaid fraud under Section 35A.02, Penal
9191 Code; or
9292 (J) bigamy under Section 25.01, Penal Code,
9393 except as provided by Subdivision (6);
9494 (4) five years from the date of the commission of the
9595 offense:
9696 (A) theft or robbery;
9797 (B) except as provided by Subdivision (5),
9898 kidnapping or burglary;
9999 (C) injury to an elderly or disabled individual
100100 that is not punishable as a felony of the first degree under Section
101101 22.04, Penal Code;
102102 (D) abandoning or endangering a child; or
103103 (E) insurance fraud;
104104 (5) if the investigation of the offense shows that the
105105 victim is younger than 17 years of age at the time the offense is
106106 committed, 20 years from the 18th birthday of the victim of one of
107107 the following offenses:
108108 (A) sexual performance by a child under Section
109109 43.25, Penal Code;
110110 (B) aggravated kidnapping under Section
111111 20.04(a)(4), Penal Code, if the defendant committed the offense
112112 with the intent to violate or abuse the victim sexually; or
113113 (C) burglary under Section 30.02, Penal Code, if
114114 the offense is punishable under Subsection (d) of that section and
115115 the defendant committed the offense with the intent to commit an
116116 offense described by Subdivision (1)(B) or (D) of this article or
117117 Paragraph (B) of this subdivision;
118118 (6) ten years from the 18th birthday of the victim of
119119 the offense:
120120 (A) trafficking of persons under Section
121121 20A.02(a)(5) or (6), Penal Code;
122122 (B) injury to a child under Section 22.04, Penal
123123 Code; or
124124 (C) bigamy under Section 25.01, Penal Code, if
125125 the investigation of the offense shows that the person, other than
126126 the legal spouse of the defendant, whom the defendant marries or
127127 purports to marry or with whom the defendant lives under the
128128 appearance of being married is younger than 18 years of age at the
129129 time the offense is committed; or
130130 (7) three years from the date of the commission of the
131131 offense: all other felonies.
132132 SECTION 3. The changes in law made by this Act do not apply
133133 to an offense if the prosecution of that offense becomes barred by
134134 limitation before the effective date of this Act. The prosecution
135135 of that offense remains barred as if this Act had not taken effect.
136136 SECTION 4. This Act takes effect September 1, 2019.
