| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Chapter 202, Property Code, is amended by adding |

| 9 | 11 | | Section 202.020 to read as follows: |

| 10 | 12 | | Sec. 202.020. REGULATION OF FIREARMS OR FIREARM AMMUNITION. |

| 11 | 13 | | A property owners' association may not include or enforce a |
|---|
| 12 | 14 | | provision in a dedicatory instrument that prohibits, restricts, or |
|---|
| 13 | 15 | | has the effect of prohibiting or restricting any person who is |
|---|
| 14 | 16 | | otherwise authorized from lawfully possessing, transporting, or |
|---|
| 15 | 17 | | storing a firearm, any part of a firearm, or firearm ammunition, as |
|---|
| 16 | 18 | | well as the otherwise lawful discharge of a firearm. |

| 17 | 19 | | SECTION 2. This Act takes effect September 1, 2019. |
