55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to forensic audits of certain school district projects.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 44, Education Code, is
1010 amended by adding Section 44.0085 to read as follows:
1111 Sec. 44.0085. FORENSIC AUDIT OF CERTAIN PROJECTS REQUIRED.
1212 (a) In this section, "capital project" means the construction,
1313 acquisition, and equipment of a public school building that are
1414 financed by the issuance of bonds under Section 45.001(a)(1)(A).
1515 (b) The board of trustees of a school district shall
1616 contract with an independent auditing firm to perform one or more
1717 forensic audits of each capital project in the district in
1818 accordance with this section.
1919 (c) A forensic audit under this section must be performed:
2020 (1) every three years if the capital project extends
2121 more than three years following the execution date of the project
2222 contract; and
2323 (2) at the completion of the project or termination of
2424 the project contract.
2525 (d) If multiple forensic audits are required under
2626 Subsection (c), a subsequent audit is not required to cover a period
2727 for which a previous audit was performed under this section.
2828 (e) A forensic audit under this section must include for the
2929 audit period the following information:
3030 (1) any performance metric or measurement tool used by
3131 the school district to evaluate the performance of the capital
3232 project;
3333 (2) the district's quality assessment plan or other
3434 assessment tool to measure risk;
3535 (3) the district's method for monitoring of
3636 deliverables, milestones, and delivery schedules under the
3737 contract, including specifying whether enhanced monitoring is used
3838 by the district;
3939 (4) a project change order or amendment to the
4040 contract;
4141 (5) a decrease or increase in the quantity of work to
4242 be performed or of materials, equipment, or supplies to be
4343 furnished under the contract;
4444 (6) a decrease or increase in the contract price of
4545 more than 25 percent;
4646 (7) project invoices and payments;
4747 (8) contractor reports made or required, including
4848 progress and financial reports;
4949 (9) district reports made or required, including site
5050 monitoring reports;
5151 (10) the length of time between each district
5252 monitoring activity;
5353 (11) any assignment by the contractor of the
5454 contractor's rights or duties under the contract;
5555 (12) any buyout or sale of the entity with which the
5656 district contracted for the project;
5757 (13) any dispute resolved, including the dispute
5858 resolution process used;
5959 (14) any corrective action plan implemented;
6060 (15) any contractor nonperformance, including any
6161 contract remedy used for contractor nonperformance;
6262 (16) any liquidated damages assessed or collected
6363 under the contract;
6464 (17) whether all or part of the contract was
6565 terminated by mutual agreement, convenience, or cause;
6666 (18) any internal audit of the project by the
6767 district;
6868 (19) a determination of compliance with:
6969 (A) any financial provision under the contract;
7070 and
7171 (B) applicable laws, rules, and district
7272 policies; and
7373 (20) any identified fraud or malfeasance.
7474 (f) A forensic audit under this section must be conducted in
7575 accordance with generally accepted auditing standards as
7676 prescribed by:
7777 (1) the American Institute of Certified Public
7878 Accountants;
7979 (2) the Governmental Accounting Standards Board;
8080 (3) the United States Government Accountability
8181 Office; or
8282 (4) any other professionally recognized entity that
8383 prescribes auditing standards.
8484 (g) A school district shall cooperate with an auditor
8585 conducting a forensic audit under this section and provide
8686 assistance to the auditor and access to all information necessary
8787 to conduct the audit, including any confidential information.
8888 (h) A contract under Subsection (b) shall require each
8989 forensic audit to be filed with the school district not later than
9090 the 90th day after the date the applicable audit period ends. The
9191 district shall make each audit available as soon as practicable for
9292 public inspection:
9393 (1) on the district's Internet website; and
9494 (2) at the district's central administrative building
9595 during regular business hours.
9696 (i) A school district shall pay for a forensic audit under
9797 this section using the proceeds from the bonds issued for the
9898 capital project.
9999 SECTION 2. Section 44.0085, Education Code, as added by
100100 this Act, applies only to a project subject to that section that is
101101 financed by bonds issued on or after the effective date of this Act.
102102 SECTION 3. This Act takes effect September 1, 2019.
