| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 755.026, Health and Safety Code, is |
|---|
| 10 | 10 | | amended by amending Subsection (a) and adding Subsection (c-1) to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) With the approval of the executive director and the |
|---|
| 13 | 13 | | inspection agency that has jurisdiction for the power boiler, the |
|---|
| 14 | 14 | | interval between internal inspections may be extended to a period |
|---|
| 15 | 15 | | not exceeding a total of 60 months. For unfired steam boilers or |
|---|
| 16 | 16 | | steam collection or liberation drums of process steam generators, |
|---|
| 17 | 17 | | the inspection interval may be extended to the next scheduled |
|---|
| 18 | 18 | | downtime of the boiler, but not exceeding a total of: |
|---|
| 19 | 19 | | (1) 84 months for unfired steam boilers; [or] |
|---|
| 20 | 20 | | (2) 120 months for steam collection or liberation |
|---|
| 21 | 21 | | drums of process steam generators manufactured before January 1, |
|---|
| 22 | 22 | | 1970; or |
|---|
| 23 | 23 | | (3) 144 months for steam collection or liberation |
|---|
| 24 | 24 | | drums of process steam generators manufactured on or after January |
|---|
| 25 | 25 | | 1, 1970. |
|---|
| 26 | 26 | | (c-1) The executive director and the inspection agency on |
|---|
| 27 | 27 | | request may grant an extension for a period not to exceed 24 months |
|---|
| 28 | 28 | | in addition to the extension authorized under Subsection (a)(2). |
|---|
| 29 | 29 | | The request must include a report issued by an engineer licensed by |
|---|
| 30 | 30 | | the Texas Board of Professional Engineers stating the conditions |
|---|
| 31 | 31 | | imposed under Subsection (b) are satisfied. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2019. |
