66 AN ACT
77 relating to the inspection of certain boilers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 755.026, Health and Safety Code, is
1010 amended by amending Subsection (a) and adding Subsection (c-1) to
1111 read as follows:
1212 (a) With the approval of the executive director and the
1313 inspection agency that has jurisdiction for the power boiler, the
1414 interval between internal inspections may be extended to a period
1515 not exceeding a total of 60 months. For unfired steam boilers or
1616 steam collection or liberation drums of process steam generators,
1717 the inspection interval may be extended to the next scheduled
1818 downtime of the boiler, but not exceeding a total of:
1919 (1) 84 months for unfired steam boilers; [or]
2020 (2) 120 months for steam collection or liberation
2121 drums of process steam generators manufactured before January 1,
2222 1970; or
2323 (3) 144 months for steam collection or liberation
2424 drums of process steam generators manufactured on or after January
2525 1, 1970.
2626 (c-1) The executive director and the inspection agency on
2727 request may grant an extension for a period not to exceed 24 months
2828 in addition to the extension authorized under Subsection (a)(2).
2929 The request must include a report issued by an engineer licensed by
3030 the Texas Board of Professional Engineers stating the conditions
3131 imposed under Subsection (b) are satisfied.
3232 SECTION 2. This Act takes effect September 1, 2019.
