65 AN ACT
76 relating to the security of the electric grid.
87 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
98 SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is
109 amended by adding Section 39.917 to read as follows:
1110 Sec. 39.917. GRID SECURITY COUNCIL. (a) The governor
1211 shall appoint members of the grid security council. Council
1312 membership must include at least one representative of each of the
1413 following:
1514 (1) the commission;
1615 (2) the independent organization certified under
1716 Section 39.151 for the ERCOT power region;
1817 (3) the Texas Military Department;
1918 (4) the Texas Division of Emergency Management;
2019 (5) the State Office of Risk Management; and
2120 (6) power generation companies.
2221 (b) The council shall monitor economic, environmental,
2322 regulatory, and technological developments that may affect the
2423 security of the electric grid.
2524 (c) Not later than the November 1 preceding each regular
2625 session of the legislature, the council shall prepare and submit a
2726 report to the legislature analyzing:
2827 (1) the developments listed in Subsection (b); and
2928 (2) the progress made towards implementing the
3029 council's previous grid security recommendations.
3130 (d) The governor shall designate a member of the council to
3231 serve as presiding officer.
3332 (e) A member of the council is not entitled to compensation.
3433 SECTION 2. (a) The grid security council shall evaluate
3534 security vulnerabilities of the electric grid and strategies for
3635 securing the grid against:
3736 (1) cyber threats;
3837 (2) physical threats;
3938 (3) weather threats;
4039 (4) solar storm threats;
4140 (5) threats of sabotage; and
4241 (6) threats relating to electromagnetic pulses.
4342 (b) Not later than November 1, 2020, the council shall
4443 prepare and submit a report to the legislature with recommendations
4544 for addressing the threats identified in Subsection (a) of this
4645 section. The council's report shall include recommendations for:
4746 (1) state agency rule changes;
4847 (2) legislation; and
4948 (3) management changes at the Public Utility
5049 Commission of Texas, the Texas Military Department, the Texas
5150 Division of Emergency Management, and the State Office of Risk
5251 Management.
5352 SECTION 3. The first report described by Section 39.917(c),
5453 Utilities Code, as added by this Act, is due November 1, 2022.
5554 SECTION 4. This Act takes effect September 1, 2019.
