8 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 8 | | SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is |
---|
10 | 9 | | amended by adding Section 39.917 to read as follows: |
---|
11 | 10 | | Sec. 39.917. GRID SECURITY COUNCIL. (a) The governor |
---|
12 | 11 | | shall appoint members of the grid security council. Council |
---|
13 | 12 | | membership must include at least one representative of each of the |
---|
14 | 13 | | following: |
---|
15 | 14 | | (1) the commission; |
---|
16 | 15 | | (2) the independent organization certified under |
---|
17 | 16 | | Section 39.151 for the ERCOT power region; |
---|
18 | 17 | | (3) the Texas Military Department; |
---|
19 | 18 | | (4) the Texas Division of Emergency Management; |
---|
20 | 19 | | (5) the State Office of Risk Management; and |
---|
21 | 20 | | (6) power generation companies. |
---|
22 | 21 | | (b) The council shall monitor economic, environmental, |
---|
23 | 22 | | regulatory, and technological developments that may affect the |
---|
24 | 23 | | security of the electric grid. |
---|
25 | 24 | | (c) Not later than the November 1 preceding each regular |
---|
26 | 25 | | session of the legislature, the council shall prepare and submit a |
---|
27 | 26 | | report to the legislature analyzing: |
---|
28 | 27 | | (1) the developments listed in Subsection (b); and |
---|
29 | 28 | | (2) the progress made towards implementing the |
---|
30 | 29 | | council's previous grid security recommendations. |
---|
31 | 30 | | (d) The governor shall designate a member of the council to |
---|
32 | 31 | | serve as presiding officer. |
---|
33 | 32 | | (e) A member of the council is not entitled to compensation. |
---|
34 | 33 | | SECTION 2. (a) The grid security council shall evaluate |
---|
35 | 34 | | security vulnerabilities of the electric grid and strategies for |
---|
36 | 35 | | securing the grid against: |
---|
37 | 36 | | (1) cyber threats; |
---|
38 | 37 | | (2) physical threats; |
---|
39 | 38 | | (3) weather threats; |
---|
40 | 39 | | (4) solar storm threats; |
---|
41 | 40 | | (5) threats of sabotage; and |
---|
42 | 41 | | (6) threats relating to electromagnetic pulses. |
---|
43 | 42 | | (b) Not later than November 1, 2020, the council shall |
---|
44 | 43 | | prepare and submit a report to the legislature with recommendations |
---|
45 | 44 | | for addressing the threats identified in Subsection (a) of this |
---|
46 | 45 | | section. The council's report shall include recommendations for: |
---|
47 | 46 | | (1) state agency rule changes; |
---|
48 | 47 | | (2) legislation; and |
---|
49 | 48 | | (3) management changes at the Public Utility |
---|
50 | 49 | | Commission of Texas, the Texas Military Department, the Texas |
---|
51 | 50 | | Division of Emergency Management, and the State Office of Risk |
---|
52 | 51 | | Management. |
---|
53 | 52 | | SECTION 3. The first report described by Section 39.917(c), |
---|
54 | 53 | | Utilities Code, as added by this Act, is due November 1, 2022. |
---|
55 | 54 | | SECTION 4. This Act takes effect September 1, 2019. |
