55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation of oyster harvesting; increasing a
88 criminal penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 76.118(c), (e-2), (e-3), (e-4), and
1111 (g), Parks and Wildlife Code, are amended to read as follows:
1212 (c) A person who violates [Section 76.116, or at the same
1313 time violates] Sections 76.109 and either Section 76.115 or 76.116
1414 in the same criminal episode[,] commits an offense that is a Class A
1515 Parks and Wildlife Code misdemeanor.
1616 (e-2) An offense related to oyster size or the harvest of
1717 oysters from a closed area is a Class B Parks and Wildlife Code
1818 misdemeanor if it is shown on the trial of the offense that [The
1919 punishment for an offense otherwise punishable under Subsection (a)
2020 is a Class B Parks and Wildlife misdemeanor if it is shown on the
2121 trial of the offense that:
2222 [(1) the defendant is the captain of a commercial
2323 oyster boat or a member of the crew of a commercial oyster boat;
2424 [(2) the provision or regulation violated relates to
2525 oyster size; and
2626 [(3)] the defendant has previously been convicted at
2727 least twice for a violation of a provision or regulation relating to
2828 oyster size or the harvest of oysters from a closed area.
2929 (e-3) An [The punishment for an] offense during the
3030 commission of which the defendant was in possession of a cargo of
3131 oysters in which 30 percent or more of the oysters measured less
3232 than three inches in length along an imaginary straight line
3333 through the long axis of the shell or an offense related to the
3434 harvest of oysters from a closed area [otherwise punishable under
3535 Subsection (a)] is a Class B [C] Parks and Wildlife Code
3636 misdemeanor, [with an attendant license suspension under Section
3737 76.1181,] if it is shown on the trial of the offense that[:
3838 [(1) the defendant is the captain of a commercial
3939 oyster boat or a member of the crew of a commercial oyster boat;
4040 [(2) the provision or regulation violated relates to
4141 oyster size and the defendant was in possession of a cargo of
4242 oysters in which 30 percent or more of the oysters measured less
4343 than three inches in length along an imaginary straight line
4444 through the long axis of the shell; and
4545 [(3)] the defendant has previously been convicted one
4646 time for a violation of a provision or regulation relating to:
4747 (1) oyster size and the defendant was in possession of
4848 a cargo of oysters in which 30 percent or more of the oysters
4949 measured less than three inches in length along an imaginary
5050 straight line through the long axis of the shell; or
5151 (2) the harvest of oysters from a closed area.
5252 (e-4) The punishment for an offense otherwise punishable
5353 under Subsection (a) is a Class A [B] Parks and Wildlife Code
5454 misdemeanor, with an attendant license suspension under Section
5555 76.1181, if it is shown on the trial of the offense that:
5656 (1) the defendant is the captain of a commercial
5757 oyster boat or a member of the crew of a commercial oyster boat;
5858 (2) the provision or regulation violated relates to:
5959 (A) oyster size and the defendant was in
6060 possession of a cargo of oysters in which 30 percent or more of the
6161 oysters measured less than three inches in length along an
6262 imaginary straight line through the long axis of the shell; or
6363 (B) the harvest of oysters from a closed area;
6464 and
6565 (3) the defendant has previously been convicted at
6666 least two times for a violation of a provision or regulation
6767 relating to:
6868 (A) oyster size and the defendant during both
6969 offenses was in possession of a cargo of oysters in which 30 percent
7070 or more of the oysters measured less than three inches in length
7171 along an imaginary straight line through the long axis of the shell;
7272 or
7373 (B) the harvest of oysters from a closed area.
7474 (g) If it is shown on [at] the trial of a defendant for a
7575 violation [at the same time] of Section 76.109 and either Section
7676 76.115 or 76.116 occurring in the same criminal episode [or Section
7777 76.205 of this code] that the defendant has been convicted once
7878 before within five years before the trial date of a violation [at
7979 the same time] of Section 76.109 and either Section 76.115 or 76.116
8080 [or 76.205 of this code] occurring in the same criminal episode, the
8181 defendant is guilty of a Parks and Wildlife Code felony.
8282 SECTION 2. The change in law made by this Act applies only
8383 to an offense committed on or after the effective date of this Act.
8484 An offense committed before the effective date of this Act is
8585 governed by the law in effect on the date the offense was committed,
8686 and the former law is continued in effect for that purpose. For
8787 purposes of this section, an offense was committed before the
8888 effective date of this Act if any element of the offense occurred
8989 before that date.
9090 SECTION 3. This Act takes effect September 1, 2019.
