55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the board of directors of the Rayburn Country Municipal
88 Utility District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 7(a) and (e), Chapter 1086, Acts of the
1111 70th Legislature, Regular Session, 1987, are amended to read as
1212 follows:
1313 (a) The district is governed by a board of five [seven]
1414 directors.
1515 (e) If any of the directors listed in Subsection (d) of this
1616 section fails to qualify for office, the remaining directors shall
1717 appoint someone to fill the vacancy for the unexpired term. If at
1818 any time the number of qualified directors is less than three [four]
1919 because of the failure or refusal of one or more directors to
2020 qualify or serve, because of death or incapacitation, or for any
2121 other reason, the Commissioners Court of Jasper County shall
2222 appoint the necessary number of directors to fill all vacancies on
2323 the board.
2424 SECTION 2. Section 9, Chapter 1086, Acts of the 70th
2525 Legislature, Regular Session, 1987, is amended to read as follows:
2626 Sec. 9. ELECTION OF DIRECTORS. An [Beginning in the second
2727 year following the confirmation and directors' election, an]
2828 election shall be held on the uniform election date [third
2929 Saturday] in May in each even-numbered year [every two years] to
3030 elect the appropriate number of directors to the board.
3131 SECTION 3. Section 7(g), Chapter 1086, Acts of the 70th
3232 Legislature, Regular Session, 1987, is repealed.
3333 SECTION 4. The changes in law made by this Act do not affect
3434 the entitlement of a member serving on the board of directors of the
3535 Rayburn Country Municipal Utility District immediately before the
3636 effective date of this Act to continue to serve as a member of the
3737 board for the remainder of the member's term. On expiration of the
3838 term of the director serving in position 7, as designated by the
3939 district, position 7 is abolished. On expiration of the term of the
4040 director serving in position 6, as designated by the district,
4141 position 6 is abolished.
4242 SECTION 5. (a) The legal notice of the intention to
4343 introduce this Act, setting forth the general substance of this
4444 Act, has been published as provided by law, and the notice and a
4545 copy of this Act have been furnished to all persons, agencies,
4646 officials, or entities to which they are required to be furnished
4747 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4848 Government Code.
4949 (b) The governor, one of the required recipients, has
5050 submitted the notice and Act to the Texas Commission on
5151 Environmental Quality.
5252 (c) The Texas Commission on Environmental Quality has filed
5353 its recommendations relating to this Act with the governor, the
5454 lieutenant governor, and the speaker of the house of
5555 representatives within the required time.
5656 (d) All requirements of the constitution and laws of this
5757 state and the rules and procedures of the legislature with respect
5858 to the notice, introduction, and passage of this Act are fulfilled
5959 and accomplished.
6060 SECTION 6. This Act takes effect September 1, 2019.
