7 | 7 | | relating to the board of directors of the Rayburn Country Municipal |

8 | 8 | | Utility District. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Sections 7(a) and (e), Chapter 1086, Acts of the |
---|
11 | 11 | | 70th Legislature, Regular Session, 1987, are amended to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (a) The district is governed by a board of five [seven] |
---|
14 | 14 | | directors. |
---|
15 | 15 | | (e) If any of the directors listed in Subsection (d) of this |
---|
16 | 16 | | section fails to qualify for office, the remaining directors shall |
---|
17 | 17 | | appoint someone to fill the vacancy for the unexpired term. If at |
---|
18 | 18 | | any time the number of qualified directors is less than three [four] |
---|
19 | 19 | | because of the failure or refusal of one or more directors to |
---|
20 | 20 | | qualify or serve, because of death or incapacitation, or for any |
---|
21 | 21 | | other reason, the Commissioners Court of Jasper County shall |
---|
22 | 22 | | appoint the necessary number of directors to fill all vacancies on |
---|
23 | 23 | | the board. |
---|
24 | 24 | | SECTION 2. Section 9, Chapter 1086, Acts of the 70th |
---|
25 | 25 | | Legislature, Regular Session, 1987, is amended to read as follows: |
---|
26 | 26 | | Sec. 9. ELECTION OF DIRECTORS. An [Beginning in the second |
---|
27 | 27 | | year following the confirmation and directors' election, an] |
---|
28 | 28 | | election shall be held on the uniform election date [third |
---|
29 | 29 | | Saturday] in May in each even-numbered year [every two years] to |
---|
30 | 30 | | elect the appropriate number of directors to the board. |
---|
31 | 31 | | SECTION 3. Section 7(g), Chapter 1086, Acts of the 70th |
---|
32 | 32 | | Legislature, Regular Session, 1987, is repealed. |
---|
33 | 33 | | SECTION 4. The changes in law made by this Act do not affect |
---|
34 | 34 | | the entitlement of a member serving on the board of directors of the |
---|
35 | 35 | | Rayburn Country Municipal Utility District immediately before the |
---|
36 | 36 | | effective date of this Act to continue to serve as a member of the |
---|
37 | 37 | | board for the remainder of the member's term. On expiration of the |
---|
38 | 38 | | term of the director serving in position 7, as designated by the |
---|
39 | 39 | | district, position 7 is abolished. On expiration of the term of the |
---|
40 | 40 | | director serving in position 6, as designated by the district, |
---|
41 | 41 | | position 6 is abolished. |

42 | 42 | | SECTION 5. (a) The legal notice of the intention to |
---|
43 | 43 | | introduce this Act, setting forth the general substance of this |
---|
44 | 44 | | Act, has been published as provided by law, and the notice and a |
---|
45 | 45 | | copy of this Act have been furnished to all persons, agencies, |
---|
46 | 46 | | officials, or entities to which they are required to be furnished |
---|
47 | 47 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
48 | 48 | | Government Code. |
---|
49 | 49 | | (b) The governor, one of the required recipients, has |
---|
50 | 50 | | submitted the notice and Act to the Texas Commission on |
---|
51 | 51 | | Environmental Quality. |
---|
52 | 52 | | (c) The Texas Commission on Environmental Quality has filed |
---|
53 | 53 | | its recommendations relating to this Act with the governor, the |
---|
54 | 54 | | lieutenant governor, and the speaker of the house of |
---|
55 | 55 | | representatives within the required time. |
---|
56 | 56 | | (d) All requirements of the constitution and laws of this |
---|
57 | 57 | | state and the rules and procedures of the legislature with respect |
---|
58 | 58 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
59 | 59 | | and accomplished. |
---|
60 | 60 | | SECTION 6. This Act takes effect September 1, 2019. |
