| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Title 4, Civil Practice and Remedies Code, is |

| 9 | 11 | | amended by adding Chapter 95A to read as follows: |

| 10 | 12 | | CHAPTER 95A. ACTIONS INVOLVING THE CARRYING OF HANDGUNS ON CERTAIN |

| 11 | 13 | | PROPERTY |
|---|
| 12 | 14 | | Sec. 95A.0001. EVIDENCE OF FAILURE TO FORBID HANDGUNS. The |
|---|
| 13 | 15 | | fact that a card, sign, or other document described by Section |
|---|
| 14 | 16 | | 30.06(c)(3) or 30.07(c)(3), Penal Code, is not posted on the |
|---|
| 15 | 17 | | property of a business or any other evidence that a person failed to |
|---|
| 16 | 18 | | exercise the person's option to forbid the carrying of a handgun by |
|---|
| 17 | 19 | | a license holder on the property: |
|---|
| 18 | 20 | | (1) is not admissible as evidence in a trial on the |
|---|
| 19 | 21 | | merits in an action: |
|---|
| 20 | 22 | | (A) against a person, including a business or |
|---|
| 21 | 23 | | other entity, who owns, controls, or manages the property; and |
|---|
| 22 | 24 | | (B) in which the cause of action arises from an |
|---|
| 23 | 25 | | injury sustained on the property; and |
|---|
| 24 | 26 | | (2) does not support a cause of action described by |
|---|
| 25 | 27 | | Subdivision (1) against a person described by that subdivision. |

| 26 | 28 | | SECTION 2. Chapter 95A, Civil Practice and Remedies Code, |
|---|
| 27 | 29 | | as added by this Act, does not apply to a cause of action that |
|---|
| 28 | 30 | | accrued before the effective date of this Act. |
|---|
| 29 | 31 | | SECTION 3. This Act takes effect September 1, 2019. |
