| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 24.07, Alcoholic Beverage Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 24.07. WHEN LICENSE ALSO HELD: HOURS OF SALE, ETC. A |
|---|
| 13 | 13 | | holder of a wine only package store permit who also holds a retail |
|---|
| 14 | 14 | | dealer's off-premise license for the same location may remain open |
|---|
| 15 | 15 | | and sell ale, wine, vinous liquors, and beer, for off-premises |
|---|
| 16 | 16 | | consumption only, on any day and during the same hours that the |
|---|
| 17 | 17 | | holder of a wine and beer retailer's permit may sell ale, beer, and |
|---|
| 18 | 18 | | wine, except that the permit holder [he] may not sell wine or vinous |
|---|
| 19 | 19 | | liquor containing more than 17 percent alcohol by volume [on a |
|---|
| 20 | 20 | | Sunday or] after 10 p.m. on any day. |

| 21 | 21 | | SECTION 2. Section 105.01, Alcoholic Beverage Code, is |
|---|
| 22 | 22 | | amended to read as follows: |
|---|
| 23 | 23 | | Sec. 105.01. HOURS OF SALE: LIQUOR. (a) Except as |
|---|
| 24 | 24 | | provided in Sections 105.02, 105.03, 105.04, and 105.08, no person |
|---|
| 25 | 25 | | may sell, offer for sale, or deliver any liquor[: |
|---|
| 26 | 26 | | [(1) on New Year's Day, Thanksgiving Day, or Christmas |
|---|
| 27 | 27 | | Day; |
|---|
| 28 | 28 | | [(2) on Sunday; or |
|---|
| 29 | 29 | | [(3)] before 10 a.m. or after 9 p.m. on any [other] |
|---|
| 30 | 30 | | day. |
|---|
| 31 | 31 | | (b) A person may not sell or offer for sale liquor on more |
|---|
| 32 | 32 | | than six days during a week. [When Christmas Day or New Year's Day |
|---|
| 33 | 33 | | falls on a Sunday, Subsection (a) of this section applies to the |
|---|
| 34 | 34 | | following Monday.] |

| 35 | 35 | | SECTION 3. Section 105.02, Alcoholic Beverage Code, is |

| 37 | 37 | | Sec. 105.02. HOURS OF SALE: WHOLESALERS AND LOCAL |

| 38 | 38 | | DISTRIBUTORS TO RETAILERS. (a) A holder of a wholesaler's permit |

| 39 | 39 | | may sell, offer for sale, or deliver liquor to a retailer anytime |

| 40 | 40 | | except a day on which a package store permittee is prohibited from |

| 41 | 41 | | selling liquor [Sunday and Christmas Day]. |

| 42 | 42 | | (b) A local distributor's permittee may sell, offer for |
|---|
| 43 | 43 | | sale, or deliver liquor to a retailer between 5 a.m. and 9 p.m. on |

| 44 | 44 | | any day except[: |
|---|
| 45 | 45 | | [(1) Sunday; |
|---|
| 46 | 46 | | [(2) Christmas Day; or |
|---|
| 47 | 47 | | [(3)] a day on which a package store permittee is |
|---|
| 48 | 48 | | prohibited from selling liquor. |

| 49 | 49 | | SECTION 4. This Act takes effect September 1, 2019. |
