65 AN ACT
76 relating to a reduced occupational licensing fee for certain former
87 license holders.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Chapter 57, Occupations Code, is amended by
1110 adding Section 57.003 to read as follows:
1211 Sec. 57.003. REDUCED OCCUPATIONAL LICENSING FEE FOR CERTAIN
1312 FORMER LICENSE HOLDERS. (a) Notwithstanding any other law, a
1413 state agency that issues a license shall adopt rules requiring the
1514 agency to charge a reduced license application fee or reactivation
1615 fee, as applicable, not to exceed one-third of the amount of the
1716 usual fee, to an applicant who:
1817 (1) in the two-year period preceding the date of the
1918 application, became a parent by natural birth or adoption; and
2019 (2) immediately before the birth or adoption, held an
2120 active license of the same type for which the person is applying.
2221 (b) Rules adopted under this section may require an
2322 applicant to submit to the state agency an attestation or other
2423 documentation relating to the child's birth or adoption.
2524 SECTION 2. Not later than September 1, 2020, a state agency
2625 to which Section 57.003, Occupations Code, as added by this Act,
2726 applies shall adopt and implement the rules required by that
2827 section.
2928 SECTION 3. A state agency to which Section 57.003,
3029 Occupations Code, as added by this Act, applies is required to
3130 implement a provision of this Act only if the legislature
3231 appropriates money specifically for that purpose. If the
3332 legislature does not appropriate money specifically for that
3433 purpose, the state agency may, but is not required to, implement a
3534 provision of this Act using other appropriations available for that
3635 purpose.
3736 SECTION 4. This Act takes effect September 1, 2019.
