57 relating to state agency electronic information and processes.
68 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
79 SECTION 1. Section 2054.0286, Government Code, is amended
810 to read as follows:
911 Sec. 2054.0286. CHIEF DATA OFFICER [STATEWIDE DATA
1012 COORDINATOR]. (a) The executive director, using existing
1113 department funds, shall employ a chief data officer [statewide data
1214 coordinator] to:
1315 (1) improve the control and security of information
1416 collected by state agencies;
1517 (2) promote between state agencies the sharing of
1618 information, including customer information; [and]
1719 (3) reduce information collection costs incurred by
1820 this state; and
1921 (4) assist the department in the development and
2022 management of a data portal for use by state agencies.
2123 (b) The chief data officer [statewide data coordinator]
2224 shall develop and implement best practices among state agencies to:
2325 (1) improve interagency information coordination;
2426 (2) reduce duplicative information collection;
2527 (3) increase accountability and ensure compliance
2628 with statutes and rules requiring agencies to share information;
2729 (4) improve information management and analysis to
2830 increase information security, uncover fraud and waste, reduce
2931 agency costs, improve agency operations, and verify compliance with
3032 applicable laws;
3133 (5) encourage agencies to collect and post on the
3234 agencies' Internet websites or the data portal managed by the
3335 department information related to an agency's [agency] functions or
3436 other data maintained by the agency that is in an open file format
3537 and is machine-readable, exportable, and easily accessible by the
3638 public; and
3739 (6) encourage the evaluation of open document formats
3840 for storing data and documents generated by state agencies.
3941 (c) Each state agency shall cooperate with the chief data
4042 officer [statewide data coordinator] in fulfilling the
4143 requirements of this section.
4244 [(d) This section expires September 1, 2021.]
4345 SECTION 2. Subchapter C, Chapter 2054, Government Code, is
4446 amended by adding Sections 2054.069 and 2054.070 to read as
4547 follows:
4648 Sec. 2054.069. DIGITAL TRANSFORMATION GUIDE. (a) The
4749 department shall establish a digital transformation guide to assist
4850 state agencies with:
4951 (1) modernizing agency operations and services with
5052 respect to electronic data; and
5153 (2) converting agency information into electronic
5254 data.
5355 (b) The department may provide:
5456 (1) mobile application development assistance;
5557 (2) paper document and form inventory assistance;
5658 (3) paperless or paper-on-request operational process
5759 planning and development; and
5860 (4) electronic notification and digital communication
5961 between the agency and the public.
6062 Sec. 2054.070. CENTRAL REPOSITORY FOR PUBLICLY ACCESSIBLE
6163 ELECTRONIC DATA. (a) The department shall:
6264 (1) establish a central repository of publicly
6365 accessible electronic data as the official open data Internet
6466 website for this state;
6567 (2) designate the repository as the Texas Open Data
6668 Portal; and
6769 (3) ensure that state agencies and political
6870 subdivisions of this state are granted shared access to the
6971 repository that allows the agencies and political subdivisions to
7072 easily post publicly accessible information to the repository.
7173 (b) Each state agency shall prioritize using the central
7274 repository of electronic data established under Subsection (a) and
7375 actively collaborate with the department on publicly accessible
7476 data issues.
7577 SECTION 3. Section 2054.071, Government Code, is amended to
7678 read as follows:
7779 Sec. 2054.071. IDENTITY OF MANAGER; CONSOLIDATION.
7880 (a) Each state agency shall designate an employee of the agency to
7981 [The presiding officer of the governing body of a state agency, if
8082 the agency is governed by one or more fully paid full-time state
8183 officials, and otherwise the executive director of the agency, or
8284 the designated representative of the presiding officer or executive
8385 director, shall] serve as the agency's information resources
8486 manager.
8587 (b) An employee [A representative] designated under
8688 Subsection (a) may be designated to serve as a joint information
8789 resources manager by two or more state agencies. The department
8890 must approve the joint designation.
8991 SECTION 4. Section 2157.007(b), Government Code, is amended
9092 to read as follows:
9193 (b) A state agency shall consider:
9294 (1) cloud computing service options, including any
9395 security benefits and cost savings associated with purchasing those
9496 service options from a cloud computing service provider and from a
9597 statewide technology center established by the department, when
9698 making purchases for a major information resources project under
9799 Section 2054.118; and
98100 (2) cloud computing service options and compatibility
99101 with cloud computing services in the development of new information
100102 technology software applications.
101103 SECTION 5. This Act takes effect September 1, 2019.
