55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to expenditures for lobbying activities made by a
88 recipient of state funds.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 556.0055, Government
1111 Code, is amended to read as follows:
1212 Sec. 556.0055. [RESTRICTIONS ON] LOBBYING EXPENDITURES BY
1313 RECIPIENT OF STATE FUNDS PROHIBITED.
1414 SECTION 2. Section 556.0055(a), Government Code, is amended
1515 to read as follows:
1616 (a) A political subdivision or private entity that receives
1717 state funds may not [use the funds to] pay:
1818 (1) lobbying expenses incurred by the recipient of the
1919 funds;
2020 (2) a person or entity that is required to register
2121 with the Texas Ethics Commission under Chapter 305;
2222 (3) any partner, employee, employer, relative,
2323 contractor, consultant, or related entity of a person or entity
2424 described by Subdivision (2); or
2525 (4) a person or entity that has been hired to represent
2626 associations or other entities for the purpose of affecting the
2727 outcome of legislation, agency rules, ordinances, or other
2828 government policies.
2929 SECTION 3. Section 556.0055(a), Government Code, as amended
3030 by this Act, applies to an expenditure made on or after the
3131 effective date of this Act. An expenditure made before the
3232 effective date of this Act is governed by the law in effect
3333 immediately before the effective date of this Act, and that law is
3434 continued in effect for that purpose.
3535 SECTION 4. This Act takes effect September 1, 2019.
