55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the local regulation of the sale of lemonade or other
88 beverages by children.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 250, Local Government
1111 Code, is amended to read as follows:
1212 CHAPTER 250. MISCELLANEOUS REGULATORY AUTHORITY [OF
1313 MUNICIPALITIES AND COUNTIES]
1414 SECTION 2. Chapter 250, Local Government Code, is amended
1515 by adding Section 250.009 to read as follows:
1616 Sec. 250.009. CERTAIN SALES OF BEVERAGES BY CHILDREN.
1717 Notwithstanding any other law, a municipality, county, or other
1818 local public health authority may not adopt or enforce an
1919 ordinance, order, or rule that prohibits an individual younger than
2020 18 years of age from temporarily selling lemonade or other
2121 nonalcoholic beverages from a stand on private property.
2222 SECTION 3. This Act takes effect September 1, 2019.
