66 AN ACT
77 relating to disease prevention and preparedness information for
88 emergency medical services personnel on certification or
99 recertification.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 773, Health and Safety
1212 Code, is amended by adding Section 773.0551 to read as follows:
1313 Sec. 773.0551. DISEASE PREVENTION AND PREPAREDNESS
1414 INFORMATION ON CERTIFICATION OF EMERGENCY MEDICAL SERVICES
1515 PERSONNEL. (a) In this section:
1616 (1) "Applicant" means an individual who files an
1717 application for certification or recertification as emergency
1818 medical services personnel under Section 773.055.
1919 (2) "Immunization registry" means the immunization
2020 registry established under Section 161.007.
2121 (b) The executive commissioner by rule shall adopt a system
2222 under which the Health and Human Services Commission provides an
2323 applicant immunization information. The system must require the
2424 commission to provide:
2525 (1) if the applicant's immunization history is
2626 included in the immunization registry, written notice of the
2727 applicant's immunization history, using information from the
2828 immunization registry; or
2929 (2) if the applicant's immunization history is not
3030 included in the immunization registry, the following information:
3131 (A) details about the program developed under
3232 Section 161.00707; and
3333 (B) the specific risks to emergency medical
3434 services personnel when responding rapidly to an emergency of
3535 exposure to and infection by a potentially serious or deadly
3636 communicable disease that an immunization may prevent.
3737 SECTION 2. As soon as practicable after the effective date
3838 of this Act, the executive commissioner of the Health and Human
3939 Services Commission shall adopt rules necessary to implement
4040 Section 773.0551, Health and Safety Code, as added by this Act.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2019.
