10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter C, Chapter 773, Health and Safety |
---|
12 | 12 | | Code, is amended by adding Section 773.0551 to read as follows: |

13 | 13 | | Sec. 773.0551. DISEASE PREVENTION AND PREPAREDNESS |
---|
14 | 14 | | INFORMATION ON CERTIFICATION OF EMERGENCY MEDICAL SERVICES |
---|
15 | 15 | | PERSONNEL. (a) In this section: |
---|
16 | 16 | | (1) "Applicant" means an individual who files an |
---|
17 | 17 | | application for certification or recertification as emergency |
---|
18 | 18 | | medical services personnel under Section 773.055. |
---|
19 | 19 | | (2) "Immunization registry" means the immunization |
---|
20 | 20 | | registry established under Section 161.007. |
---|
21 | 21 | | (b) The executive commissioner by rule shall adopt a system |
---|
22 | 22 | | under which the Health and Human Services Commission provides an |
---|
23 | 23 | | applicant immunization information. The system must require the |
---|
24 | 24 | | commission to provide: |
---|
25 | 25 | | (1) if the applicant's immunization history is |
---|
26 | 26 | | included in the immunization registry, written notice of the |
---|
27 | 27 | | applicant's immunization history, using information from the |
---|
28 | 28 | | immunization registry; or |
---|
29 | 29 | | (2) if the applicant's immunization history is not |
---|
30 | 30 | | included in the immunization registry, the following information: |
---|
31 | 31 | | (A) details about the program developed under |
---|
32 | 32 | | Section 161.00707; and |
---|
33 | 33 | | (B) the specific risks to emergency medical |
---|
34 | 34 | | services personnel when responding rapidly to an emergency of |
---|
35 | 35 | | exposure to and infection by a potentially serious or deadly |
---|
36 | 36 | | communicable disease that an immunization may prevent. |
---|
37 | 37 | | SECTION 2. As soon as practicable after the effective date |
---|
38 | 38 | | of this Act, the executive commissioner of the Health and Human |
---|
39 | 39 | | Services Commission shall adopt rules necessary to implement |
---|
40 | 40 | | Section 773.0551, Health and Safety Code, as added by this Act. |
---|
41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
---|
42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
---|
43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
---|
45 | 45 | | Act takes effect September 1, 2019. |
