66 AN ACT
77 relating to the regulation of the conduct of certain counseling
88 professions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 501, Occupations Code, is
1111 amended by adding Section 501.0031 to read as follows:
1212 Sec. 501.0031. REFUSAL BASED ON RELIGIOUS BELIEF. (a) In
1313 this section, "psychological services" has the meaning assigned by
1414 Section 501.003.
1515 (b) A person who holds a license under this chapter may
1616 refuse to provide a psychological service to a person if providing
1717 the service would cause the license holder to violate a sincerely
1818 held religious belief.
1919 (c) A license holder who refuses to provide a psychological
2020 service to a person under Subsection (b) shall coordinate a
2121 referral of the person to a psychologist, marriage and family
2222 therapist, licensed professional counselor, chemical dependency
2323 counselor, social worker, or licensed behavior analyst, as
2424 appropriate, who agrees to provide the counseling or therapy
2525 service.
2626 (d) The board may not take disciplinary action against or
2727 impose an administrative penalty on a license holder based on the
2828 license holder's refusal to provide a psychological service under
2929 Subsection (b).
3030 (e) A person may not bring a cause of action against a
3131 license holder based on the license holder's refusal to provide a
3232 psychological service under Subsection (b).
3333 (f) This state or a political subdivision of this state may
3434 not penalize or withhold benefits, including tax exemptions,
3535 governmental contracts, or grants, from a license holder based on
3636 the license holder's refusal to provide a psychological service
3737 under Subsection (b).
3838 (g) A license holder's refusal to provide a psychological
3939 service under Subsection (b) is not conduct that constitutes an
4040 element of a criminal offense.
4141 SECTION 2. Subchapter A, Chapter 502, Occupations Code, is
4242 amended by adding Section 502.005 to read as follows:
4343 Sec. 502.005. REFUSAL BASED ON RELIGIOUS BELIEF. (a) A
4444 person who holds a license under this chapter may refuse to provide
4545 marriage and family therapy to a person if providing the therapy
4646 would cause the license holder to violate a sincerely held
4747 religious belief.
4848 (b) A license holder who refuses to provide marriage and
4949 family therapy to a person under Subsection (a) shall coordinate a
5050 referral of the person to a psychologist, marriage and family
5151 therapist, licensed professional counselor, chemical dependency
5252 counselor, social worker, or licensed behavior analyst, as
5353 appropriate, who agrees to provide the counseling or therapy
5454 service.
5555 (c) The board may not take disciplinary action against or
5656 impose an administrative penalty on a license holder based on the
5757 license holder's refusal to provide marriage and family therapy
5858 under Subsection (a).
5959 (d) A person may not bring a cause of action against a
6060 license holder based on the license holder's refusal to provide
6161 marriage and family therapy under Subsection (a).
6262 (e) This state or a political subdivision of this state may
6363 not penalize or withhold benefits, including tax exemptions,
6464 governmental contracts, or grants, from a license holder based on
6565 the license holder's refusal to provide marriage and family therapy
6666 under Subsection (a).
6767 (f) A license holder's refusal to provide marriage and
6868 family therapy under Subsection (a) is not conduct that constitutes
6969 an element of a criminal offense.
7070 SECTION 3. Subchapter A, Chapter 503, Occupations Code, is
7171 amended by adding Section 503.0031 to read as follows:
7272 Sec. 503.0031. REFUSAL BASED ON RELIGIOUS BELIEF. (a) A
7373 licensed professional counselor may refuse to provide a service
7474 within the practice of professional counseling to a person if
7575 providing the service would cause the counselor to violate a
7676 sincerely held religious belief.
7777 (b) A licensed professional counselor who refuses to
7878 provide a service to a person under Subsection (a) shall coordinate
7979 a referral of the person to a psychologist, marriage and family
8080 therapist, licensed professional counselor, chemical dependency
8181 counselor, social worker, or licensed behavior analyst, as
8282 appropriate, who agrees to provide the counseling or therapy
8383 service.
8484 (c) The board may not take disciplinary action against or
8585 impose an administrative penalty on a licensed professional
8686 counselor based on the counselor's refusal to provide a service
8787 under Subsection (a).
8888 (d) A person may not bring a cause of action against a
8989 licensed professional counselor based on the counselor's refusal to
9090 provide a service under Subsection (a).
9191 (e) This state or a political subdivision of this state may
9292 not penalize or withhold benefits, including tax exemptions,
9393 governmental contracts, or grants, from a licensed professional
9494 counselor based on the counselor's refusal to provide a service
9595 under Subsection (a).
9696 (f) A licensed professional counselor's refusal to provide
9797 a service under Subsection (a) is not conduct that constitutes an
9898 element of a criminal offense.
9999 SECTION 4. Subchapter A, Chapter 504, Occupations Code, is
100100 amended by adding Section 504.003 to read as follows:
101101 Sec. 504.003. REFUSAL BASED ON RELIGIOUS BELIEF. (a) A
102102 person who holds a license, registration, or certification under
103103 this chapter may refuse to provide chemical dependency counseling
104104 to a person if providing the counseling would cause the holder to
105105 violate a sincerely held religious belief.
106106 (b) A license, registration, or certificate holder who
107107 refuses to provide chemical dependency counseling to a person under
108108 Subsection (a) shall coordinate a referral of the person to a
109109 psychologist, marriage and family therapist, licensed professional
110110 counselor, chemical dependency counselor, social worker, or
111111 licensed behavior analyst, as appropriate, who agrees to provide
112112 the counseling or therapy service.
113113 (c) The department may not take disciplinary action against
114114 or impose an administrative penalty on a person who holds a license,
115115 registration, or certification based on the holder's refusal to
116116 provide chemical dependency counseling under Subsection (a).
117117 (d) A person may not bring a cause of action against a person
118118 who holds a license, registration, or certification based on the
119119 holder's refusal to provide chemical dependency counseling under
120120 Subsection (a).
121121 (e) This state or a political subdivision of this state may
122122 not penalize or withhold benefits, including tax exemptions,
123123 governmental contracts, or grants, from a license, registration, or
124124 certificate holder based on the holder's refusal to provide
125125 chemical dependency counseling under Subsection (a).
126126 (f) A license, registration, or certificate holder's
127127 refusal to provide chemical dependency counseling under Subsection
128128 (a) is not conduct that constitutes an element of a criminal
129129 offense.
130130 SECTION 5. Subchapter A, Chapter 505, Occupations Code, is
131131 amended by adding Section 505.0026 to read as follows:
132132 Sec. 505.0026. REFUSAL BASED ON RELIGIOUS BELIEF. (a) A
133133 social worker may refuse to provide a service within the practice of
134134 social work to a person if providing the service would cause the
135135 social worker to violate a sincerely held religious belief.
136136 (b) A social worker who refuses to provide a service to a
137137 person under Subsection (a) shall coordinate a referral of the
138138 person to a psychologist, marriage and family therapist, licensed
139139 professional counselor, chemical dependency counselor, social
140140 worker, or licensed behavior analyst, as appropriate, who agrees to
141141 provide the counseling or therapy service.
142142 (c) The board may not take disciplinary action against or
143143 impose an administrative penalty on a social worker based on the
144144 social worker's refusal to provide a service under Subsection (a).
145145 (d) A person may not bring a cause of action against a social
146146 worker based on the social worker's refusal to provide a service
147147 under Subsection (a).
148148 (e) This state or a political subdivision of this state may
149149 not penalize or withhold benefits, including tax exemptions,
150150 governmental contracts, or grants, from a social worker based on
151151 the social worker's refusal to provide a service under Subsection
152152 (a).
153153 (f) A social worker's refusal to provide a service under
154154 Subsection (a) is not conduct that constitutes an element of a
155155 criminal offense.
156156 SECTION 6. Subchapter A, Chapter 506, Occupations Code, is
157157 amended by adding Section 506.004 to read as follows:
158158 Sec. 506.004. REFUSAL BASED ON RELIGIOUS BELIEF. (a) A
159159 person who holds a license under this chapter may refuse to provide
160160 a service within the practice of applied behavior analysis to a
161161 person if providing the service would cause the license holder to
162162 violate a sincerely held religious belief.
163163 (b) A license holder who refuses to provide a service to a
164164 person under Subsection (a) shall coordinate a referral of the
165165 person to a psychologist, marriage and family therapist, licensed
166166 professional counselor, chemical dependency counselor, social
167167 worker, or licensed behavior analyst, as appropriate, who agrees to
168168 provide the counseling or therapy service.
169169 (c) The board may not take disciplinary action against or
170170 impose an administrative penalty on a license holder based on the
171171 license holder's refusal to provide a service under Subsection (a).
172172 (d) A person may not bring a cause of action against a
173173 license holder based on the license holder's refusal to provide a
174174 service under Subsection (a).
175175 (e) This state or a political subdivision of this state may
176176 not penalize or withhold benefits, including tax exemptions,
177177 governmental contracts, or grants, from a license holder based on
178178 the license holder's refusal to provide a service under Subsection
179179 (a).
180180 (f) A license holder's refusal to provide a service under
181181 Subsection (a) is not conduct that constitutes an element of a
182182 criminal offense.
183183 SECTION 7. The change in law made by this Act applies only
184184 to conduct that occurs on or after the effective date of this Act.
185185 Conduct that occurs before the effective date of this Act is
186186 governed by the law in effect on the date the conduct occurred, and
187187 the former law is continued in effect for that purpose.
188188 SECTION 8. This Act takes effect September 1, 2019.
