55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on freestanding emergency medical care
88 facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In this Act:
1111 (1) "Commission" means the Health and Human Services
1212 Commission.
1313 (2) "Facility" means a freestanding emergency medical
1414 care facility licensed under Chapter 254, Health and Safety Code.
1515 (b) The commission shall conduct a study on freestanding
1616 emergency medical care facilities that:
1717 (1) reviews the impact facilities have on medically
1818 underserved and rural areas of this state;
1919 (2) reviews the impact facilities have on rural
2020 hospitals in this state;
2121 (3) reviews the impact facilities have on hospital
2222 emergency rooms in this state;
2323 (4) reviews complaints filed against facilities;
2424 (5) examines the reasons facilities have closed;
2525 (6) examines the reasons facilities have filed
2626 petitions for bankruptcy;
2727 (7) examines patient protections provided by
2828 facilities and patient health care coverage available at the
2929 facilities;
3030 (8) examines the location of facilities, the growth
3131 patterns of new facilities, and the proximity of the new facilities
3232 to hospital emergency rooms; and
3333 (9) identifies gaps in emergency medical care
3434 treatment that are filled by facilities.
3535 (c) Not later than December 1, 2020, the commission shall
3636 prepare and submit to the governor, lieutenant governor, speaker of
3737 the house of representatives, and members of the legislature a
3838 written report that includes a summary of the results of the study
3939 conducted under this section and any legislative recommendations
4040 based on the study.
4141 (d) This Act expires September 1, 2021.
4242 SECTION 2. This Act takes effect September 1, 2019.
