55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of the student mental health division
88 within the Texas Education Agency.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 7, Education Code, is
1111 amended by adding Section 7.041 to read as follows:
1212 Sec. 7.041. STUDENT MENTAL HEALTH DIVISION. The
1313 commissioner by rule shall establish the student mental health
1414 division within the agency to:
1515 (1) develop and administer a plan to identify,
1616 leverage, and align existing agency resources to promote the
1717 academic success of students with mental health needs, including
1818 students in special education programs under Subchapter A, Chapter
1919 29; and
2020 (2) promote strong local and statewide
2121 school-community partnerships by coordinating with community-based
2222 mental health services providers, youth services providers, and
2323 school district resources, including school counselors, and with
2424 relevant state agencies, including the Health and Human Services
2525 Commission, the Department of State Health Services, the Department
2626 of Family and Protective Services, the Texas Workforce Commission,
2727 and the Texas Juvenile Justice Department.
2828 SECTION 2. As soon as practicable after the effective date
2929 of this Act, the commissioner of education shall adopt rules
3030 establishing the student mental health division within the Texas
3131 Education Agency as required by Section 7.041, Education Code, as
3232 added by this Act.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2019.
