65 AN ACT
76 relating to requiring training for certain emergency management
87 coordinators.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Sections 418.005(a), (b), (c), and (e),
1110 Government Code, are amended to read as follows:
1211 (a) This section applies only to:
1312 (1) an elected law enforcement officer or county
1413 judge, or an appointed public officer of the state or of a political
1514 subdivision, who has management or supervisory responsibilities
1615 and:
1716 (A) [(1)] whose position description, job
1817 duties, or assignment includes emergency management
1918 responsibilities; or
2019 (B) [(2)] who plays a role in emergency
2120 preparedness, response, or recovery; and
2221 (2) an emergency management coordinator designated
2322 under Section 418.1015(c) by the emergency management director of a
2423 county with a population of 500,000 or more.
2524 (b) Each person described by Subsection (a) shall complete a
2625 course of training provided or approved by the division of not less
2726 than three hours regarding the responsibilities of state and local
2827 governments under this chapter not later than the 180th day after
2928 the date the person:
3029 (1) takes the oath of office, if the person is required
3130 to take an oath of office to assume the person's duties as a public
3231 officer; [or]
3332 (2) otherwise assumes responsibilities as a public
3433 officer, if the person is not required to take an oath of office to
3534 assume the person's duties; or
3635 (3) is designated as an emergency management
3736 coordinator under Section 418.1015(c).
3837 (c) The division shall develop and provide a training course
3938 related to the emergency management responsibilities of
4039 state-level officers and a training course related to the emergency
4140 management responsibilities of officers and emergency management
4241 coordinators of political subdivisions. The division shall ensure
4342 that the training courses satisfy the requirements of Subsection
4443 (b).
4544 (e) The division or other entity providing the training
4645 shall provide a certificate of course completion to a person
4746 [public officers] who completes [complete] the training required by
4847 this section. A person [public officer] who completes the training
4948 required by this section shall maintain and make available for
5049 public inspection the record of the person's [public officer's]
5150 completion of the training.
5251 SECTION 2. Not later than March 1, 2020, each person who is
5352 required to complete a course of training under Section 418.005,
5453 Government Code, as amended by this Act, must complete the
5554 training.
5655 SECTION 3. This Act takes effect September 1, 2019.
