46 AN ACT
57 relating to forms for creating or revoking a transfer on death deed.
68 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
79 SECTION 1. Section 22.020(a), Government Code, is amended
810 by adding Subdivision (3) to read as follows:
911 (3) "Transfer on death deed" has the meaning assigned
1012 by Section 114.002, Estates Code.
1113 SECTION 2. Section 22.020(b), Government Code, is amended
1214 to read as follows:
1315 (b) The supreme court shall, as the court considers
1416 appropriate, promulgate:
1517 (1) forms for use by individuals representing
1618 themselves in certain probate matters, including forms for use in:
1719 (A) a small estate affidavit proceeding under
1820 Chapter 205, Estates Code; and
1921 (B) the probate of a will as a muniment of title
2022 under Chapter 257, Estates Code;
2123 (2) a simple will form for:
2224 (A) a married individual with an adult child;
2325 (B) a married individual with a minor child;
2426 (C) a married individual with no children;
2527 (D) an unmarried individual with an adult child;
2628 (E) an unmarried individual with a minor child;
2729 and
2830 (F) an unmarried individual with no children;
2931 (2-a) a form for use to create a transfer on death deed
3032 and a form for use to create an instrument of revocation of a
3133 transfer on death deed under Chapter 114, Estates Code; and
3234 (3) instructions for the proper use of each form or set
3335 of forms.
3436 SECTION 3. The following provisions of the Estates Code are
3537 repealed:
3638 (1) Section 114.002(b); and
3739 (2) Subchapter D, Chapter 114.
3840 SECTION 4. The repeal of Subchapter D, Chapter 114, Estates
3941 Code, by this Act does not affect the validity of a transfer on
4042 death deed or a cancellation of a transfer on death deed executed
4143 before, on, or after the effective date of this Act.
4244 SECTION 5. This Act takes effect September 1, 2019.
