55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a limitation on the amount of tuition and fees charged
88 to students by public institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 54, Education Code, is
1111 amended by adding Section 54.0514 to read as follows:
1212 Sec. 54.0514. LIMITATION ON TUITION CHARGES. (a) In this
1313 section, "tuition" includes:
1414 (1) tuition for which the rates are prescribed by this
1515 chapter; and
1616 (2) tuition charged by an institution of higher
1717 education under Section 54.0513 or another law authorizing an
1818 institution to establish tuition rates.
1919 (b) The total amount of tuition charged by an institution of
2020 higher education to a student for an academic year may not exceed
2121 the total amount of tuition that the institution would have charged
2222 under this chapter to a similarly situated student for the
2323 2019-2020 academic year, as that amount is adjusted for inflation
2424 for each academic year by applying the inflation rate determined by
2525 the comptroller on the basis of changes in the Texas Consumer Price
2626 Index. For purposes of this subsection, students are similarly
2727 situated if they share the same residency status, degree program,
2828 course load, course level, tuition exemption status, and other
2929 circumstances affecting the tuition charged to the student. This
3030 subsection does not ensure that the total amount of tuition charged
3131 to an individual student does not increase based on a change in the
3232 student's residency status, degree program, course load, course
3333 level, tuition exemption status, or other circumstance affecting
3434 the tuition charged to the student.
3535 (c) The Texas Higher Education Coordinating Board may adopt
3636 rules as necessary to administer this section.
3737 SECTION 2. Sections 54.0513(a) and (b), Education Code, are
3838 amended to read as follows:
3939 (a) In addition to amounts that a governing board of an
4040 institution of higher education is authorized to charge as tuition
4141 under the other provisions of this chapter, the governing board[,
4242 under the terms the governing board considers appropriate,] may
4343 charge any student an amount designated as tuition not to exceed the
4444 amount that enables the institution to comply with Section 54.0514
4545 that the governing board considers necessary for the effective
4646 operation of the institution.
4747 (b) Subject to the limit provided by Subsection (a) on the
4848 amount designated as tuition charged under this section, a [A]
4949 governing board may set a different tuition rate under this section
5050 for each program and course level offered by each institution of
5151 higher education[. A governing board may set a different tuition
5252 rate] as the governing board considers appropriate to increase
5353 graduation rates, encourage efficient use of facilities, or enhance
5454 employee performance.
5555 SECTION 3. Sections 54.0515(e) and (f), Education Code, are
5656 amended to read as follows:
5757 (e) It is the legislature's intent that each institution of
5858 higher education[, as a condition to tuition deregulation under
5959 Section 54.0513,] reasonably implement the following:
6060 (1) each institution shall make satisfactory progress
6161 towards the goals provided in its master plan for higher education
6262 and in ["Closing the Gaps,"] the state's master plan for higher
6363 education; and
6464 (2) each institution shall meet acceptable
6565 performance criteria, including measures such as graduation rates,
6666 retention rates, enrollment growth, educational quality, efforts
6767 to enhance minority participation, opportunities for financial
6868 aid, and affordability.
6969 (f) The committee shall:
7070 (1) meet at the call of either chair;
7171 (2) monitor and regularly report to the legislature on
7272 each institution of higher education's compliance with the
7373 requirements of Subsection (e); and
7474 (3) receive and review information concerning the
7575 affordability and accessibility of higher education[, including
7676 the impact of tuition deregulation].
7777 SECTION 4. Subchapter E, Chapter 54, Education Code, is
7878 amended by adding Section 54.5001 to read as follows:
7979 Sec. 54.5001. LIMITATIONS ON FEE INCREASES WITHOUT STUDENT
8080 APPROVAL. (a) Notwithstanding any other provision of this
8181 subchapter or other law and except as provided by Subsection (b),
8282 the governing board of an institution of higher education may not
8383 increase the amount of a fee charged under this subchapter to an
8484 amount that is greater than the amount charged by the institution in
8585 the preceding academic year as adjusted by applying the inflation
8686 rate determined by the comptroller on the basis of changes in the
8787 Texas Consumer Price Index.
8888 (b) Subsection (a) does not apply to an increase in the
8989 amount of a fee if the increase is approved by a vote of the students
9090 of the institution voting in a student election authorized by law
9191 for that purpose.
9292 (c) This section does not:
9393 (1) provide independent authority for the governing
9494 board of an institution of higher education to increase the amount
9595 of a fee or to call a student election to approve an increase in the
9696 amount of a fee; or
9797 (2) authorize the governing board of an institution of
9898 higher education to increase the amount of a fee charged under this
9999 subchapter to an amount that exceeds the maximum amount prescribed
100100 by the law authorizing the fee's imposition, if that law prescribes
101101 a maximum amount.
102102 (d) The Texas Higher Education Coordinating Board may adopt
103103 rules as necessary to administer this section.
104104 SECTION 5. (a) The changes in law made by this Act to
105105 Subchapter B, Chapter 54, Education Code, apply beginning with
106106 tuition charged by public institutions of higher education for the
107107 2020-2021 academic year. Tuition charged by an institution of
108108 higher education in an academic year before that academic year is
109109 covered by the law in effect before the effective date of this Act,
110110 and the former law is continued in effect for that purpose.
111111 (b) Section 54.5001, Education Code, as added by this Act,
112112 applies beginning with fee increases for the 2020 fall semester.
113113 SECTION 6. This Act takes effect January 1, 2020.
