7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. Subchapter A, Chapter 442, Government Code, is |
---|
9 | 11 | | amended by adding Section 442.0074 to read as follows: |

10 | 12 | | Sec. 442.0074. PRESERVATION, MAINTENANCE, AND IMPROVEMENT |
---|
11 | 13 | | OF REPUBLIC OF TEXAS GRANITE BOUNDARY MARKER. (a) In this |
---|
12 | 14 | | section, "boundary marker" means the granite marker designating the |
---|
13 | 15 | | former international boundary between the Republic of Texas and the |
---|
14 | 16 | | United States, originally placed in 1841 at its location in Panola |
---|
15 | 17 | | County near Farm to Market Road No. 31, at or about 32°2'3"N, |
---|
16 | 18 | | 94°2'35"W, and known as the Republic of Texas Granite Boundary |
---|
17 | 19 | | Marker and the International Boundary Marker. |
---|
18 | 20 | | (b) To the extent authorized by law, the commission shall |
---|
19 | 21 | | preserve, maintain, and improve the boundary marker and state land |
---|
20 | 22 | | adjacent to the boundary marker and shall: |
---|
21 | 23 | | (1) design and construct a structure or device |
---|
22 | 24 | | sufficient to protect the boundary marker from vandalism, theft, |
---|
23 | 25 | | and natural elements; |
---|
24 | 26 | | (2) display historical and educational information on |
---|
25 | 27 | | a sign or plaque at the boundary marker site to inform the public of |
---|
26 | 28 | | the history of the boundary marker and the region; |
---|
27 | 29 | | (3) cooperate with the federal government and other |
---|
28 | 30 | | persons as necessary to facilitate the implementation of duties |
---|
29 | 31 | | imposed by this section; and |
---|
30 | 32 | | (4) take other action the commission determines |
---|
31 | 33 | | necessary to preserve, maintain, restore, and improve the boundary |
---|
32 | 34 | | marker and the state grounds adjacent to the boundary marker for the |
---|
33 | 35 | | beautification and cultural enhancement of the property as a |
---|
34 | 36 | | significant historical site in this state. |
---|
35 | 37 | | (c) Notwithstanding any other law, any power or duty related |
---|
36 | 38 | | to the boundary marker formerly vested in another state agency is |
---|
37 | 39 | | vested solely in the commission. |
---|
38 | 40 | | (d) The commission may spend money appropriated to the |
---|
39 | 41 | | commission for purposes of this section only to accomplish those |
---|
40 | 42 | | purposes. |
---|
41 | 43 | | (e) The commission may solicit and accept gifts, grants, and |
---|
42 | 44 | | donations of money or property from any public or private source to |
---|
43 | 45 | | be used for the purposes of this section. |
---|
44 | 46 | | (f) The commission, in consultation with each state senator |
---|
45 | 47 | | and representative in whose district the boundary marker is located |
---|
46 | 48 | | and other interested parties, may: |
---|
47 | 49 | | (1) replace the original boundary marker with a |
---|
48 | 50 | | replica boundary marker; |
---|
49 | 51 | | (2) preserve, maintain, and display the original |
---|
50 | 52 | | boundary marker at the Bob Bullock Texas State History Museum; and |
---|
51 | 53 | | (3) perform the duties assigned by Subsection (b) with |
---|
52 | 54 | | respect to the replica boundary marker at the original boundary |
---|
53 | 55 | | marker location. |
---|
54 | 56 | | SECTION 2. The Texas Historical Commission is required to |
---|
55 | 57 | | implement a provision of this Act only if the legislature |
---|
56 | 58 | | appropriates money specifically for that purpose. If the |
---|
57 | 59 | | legislature does not appropriate money specifically for that |
---|
58 | 60 | | purpose, the Texas Historical Commission may, but is not required |
---|
59 | 61 | | to, implement a provision of this Act using other appropriations |
---|
60 | 62 | | available for that purpose. |
---|
61 | 63 | | SECTION 3. This Act takes effect September 1, 2019. |
