 Substitute the following for S.B. No. 926:  No.


 A BILL TO BE ENTITLED
 AN ACT
 relating to the operation of a public school transportation system
 in certain counties.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 34.007, Education Code, is amended by
 amending Subsection (a) and adding Subsection (a-1) to read as
 follows:
 (a)  A board of county school trustees or a school district
 board of trustees may establish and operate an economical public
 school transportation system:
 (1)  in the county or district, as applicable; or
 (2)  outside the county or district, as applicable, if:
 (A)  the county or school district enters into an
 interlocal contract as provided by Chapter 791, Government Code; or
 (B)  for a county system or school district
 described by Subsection (a-1), students served by the county system
 or enrolled in the school district reside outside the county or
 district, as applicable.
 (a-1)  Subsection (a)(2)(B) applies only to a county system
 or school district located in a county that:
 (1)  has a population of:
 (A)  less than 40,000; or
 (B)  more than 285,000 and less than 300,000; and
 (2)  is adjacent to a county with a population of more
 than 3.3 million.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2019.
