9 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 9 | | SECTION 1. Sections 410.252(a) and (d), Labor Code, are |
---|
11 | 10 | | amended to read as follows: |

12 | 11 | | (a) A party may seek judicial review by filing suit not |
---|
13 | 12 | | later than the 60th [45th] day after the date on which the division |
---|
14 | 13 | | mailed the party the decision of the appeals panel. For purposes of |
---|
15 | 14 | | this section, the mailing date is considered to be the fifth day |
---|
16 | 15 | | after the date the decision of the appeals panel was filed with the |
---|
17 | 16 | | division. |
---|
18 | 17 | | (d) If a suit is initially filed within the 60-day [45-day] |
---|
19 | 18 | | period in Subsection (a), and is transferred under Subsection (c), |
---|
20 | 19 | | the suit is considered to be timely filed in the court to which it is |
---|
21 | 20 | | transferred. |

22 | 21 | | SECTION 2. The change in law made by this Act applies only |
---|
23 | 22 | | to a suit for judicial review filed on or after the effective date |
---|
24 | 23 | | of this Act. A suit for judicial review filed before the effective |
---|
25 | 24 | | date of this Act is covered by the law as it existed on the date the |
---|
26 | 25 | | suit was filed, and the former law is continued in effect for that |
---|
27 | 26 | | purpose. |

28 | 27 | | SECTION 3. This Act takes effect September 1, 2019. |
