65 AN ACT
76 relating to drug or alcohol overdose awareness and response
87 training for residential advisors and officers of student
98 organizations at public or private institutions of higher
109 education.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1312 amended by adding Section 51.9362 to read as follows:
1413 Sec. 51.9362. DRUG AND ALCOHOL AWARENESS TRAINING FOR
1514 RESIDENTIAL ADVISORS AND STUDENT ORGANIZATION OFFICERS. (a) In
1615 this section:
1716 (1) "Public or private institution of higher
1817 education" includes an "institution of higher education" and a
1918 "private or independent institution of higher education," as those
2019 terms are defined by Section 61.003.
2120 (2) "Residential advisor" means a student who is
2221 employed by a public or private institution of higher education to
2322 serve in an advisory capacity for students living in a residential
2423 facility.
2524 (3) "Residential facility" means a residence used
2625 exclusively for housing or boarding students or faculty of a public
2726 or private institution of higher education.
2827 (4) "Student organization" includes any organization
2928 that is composed mostly of students enrolled at a public or private
3029 institution of higher education and that:
3130 (A) is registered with the institution;
3231 (B) receives student organization resource fee
3332 revenues or other funding from the institution; or
3433 (C) is otherwise recognized as a student
3534 organization by the institution.
3635 (b) A public or private institution of higher education that
3736 imposes any mandatory training requirements on residential
3837 advisors or officers of student organizations must ensure that drug
3938 and alcohol overdose awareness and appropriate response training is
4039 included with that training.
4140 SECTION 2. This Act applies beginning with training
4241 required for the 2019-2020 academic year.
4342 SECTION 3. This Act takes effect immediately if it receives
4443 a vote of two-thirds of all the members elected to each house, as
4544 provided by Section 39, Article III, Texas Constitution. If this
4645 Act does not receive the vote necessary for immediate effect, this
4746 Act takes effect September 1, 2019.
