| 8 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 14 | | SECTION 1. Section 30A.002(b), Education Code, is amended |
|---|
| 10 | 15 | | to read as follows: |
|---|
| 11 | 16 | | (b) A student is eligible to enroll full-time in courses |
|---|
| 12 | 17 | | provided through the state virtual school network only if the |
|---|
| 13 | 18 | | student: |
|---|
| 14 | 19 | | (1) was enrolled in a public school in this state in |
|---|
| 15 | 20 | | the preceding school year; or |
|---|
| 16 | 21 | | (2) regardless of whether the student was enrolled in |
|---|
| 17 | 22 | | a public school in this state in the preceding school year: |
|---|
| 18 | 23 | | (A) is a dependent of a member of the United |
|---|
| 19 | 24 | | States military who has been deployed or transferred to, or |
|---|
| 20 | 25 | | otherwise currently resides in, this state [and was enrolled in a |
|---|
| 21 | 26 | | publicly funded school outside of this state in the preceding |
|---|
| 22 | 27 | | school year]; or |
|---|
| 23 | 28 | | (B) [(3)] has been placed in substitute care in |
|---|
| 24 | 29 | | this state[, regardless of whether the student was enrolled in a |
|---|
| 25 | 30 | | public school in this state in the preceding school year]. |
|---|
| 26 | 31 | | SECTION 2. This Act applies beginning with the 2019-2020 |
|---|
| 27 | 32 | | school year. |
|---|
| 28 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 37 | | Act takes effect September 1, 2019. |
