49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to the ability of certain students to enroll full-time in
712 courses provided through the state virtual school network.
813 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
914 SECTION 1. Section 30A.002(b), Education Code, is amended
1015 to read as follows:
1116 (b) A student is eligible to enroll full-time in courses
1217 provided through the state virtual school network only if the
1318 student:
1419 (1) was enrolled in a public school in this state in
1520 the preceding school year; or
1621 (2) regardless of whether the student was enrolled in
1722 a public school in this state in the preceding school year:
1823 (A) is a dependent of a member of the United
1924 States military who has been deployed or transferred to, or
2025 otherwise currently resides in, this state [and was enrolled in a
2126 publicly funded school outside of this state in the preceding
2227 school year]; or
2328 (B) [(3)] has been placed in substitute care in
2429 this state[, regardless of whether the student was enrolled in a
2530 public school in this state in the preceding school year].
2631 SECTION 2. This Act applies beginning with the 2019-2020
2732 school year.
2833 SECTION 3. This Act takes effect immediately if it receives
2934 a vote of two-thirds of all the members elected to each house, as
3035 provided by Section 39, Article III, Texas Constitution. If this
3136 Act does not receive the vote necessary for immediate effect, this
3237 Act takes effect September 1, 2019.
