55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the consequences of a criminal conviction on a person's
88 eligibility for an occupational license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 53.021(a-1), Occupations Code, is
1111 amended to read as follows:
1212 (a-1) Subsections (a)(1), (3), and (4) do [Subsection (a)
1313 does] not apply to a person who has been convicted only of an
1414 offense punishable as a Class C misdemeanor, and Subsection (a)(2)
1515 does not apply to a person who has been convicted only of an offense
1616 punishable as a Class B or C misdemeanor, unless:
1717 (1) the person is an applicant for or the holder of a
1818 license that authorizes the person to possess a firearm; and
1919 (2) the offense for which the person was convicted is a
2020 misdemeanor crime of domestic violence as that term is defined by 18
2121 U.S.C. Section 921.
2222 SECTION 2. The change in law made by this Act applies to an
2323 application for, or a disciplinary proceeding regarding, a license
2424 or other authorization that is pending with a licensing authority
2525 on the effective date of this Act or an application filed or a
2626 disciplinary proceeding commenced on or after that date.
2727 SECTION 3. This Act takes effect September 1, 2019.
